My point was not about Trump. It was questioning this idea that the jury doesn’t have to agree on what crime was committed, only that the accused did some kind of crime. Perhaps that’s how the legal system works. If it is that strikes me as sad.
Yep, non-violent and first time offender (1st time caught anyway) likely wouldn’t get any jail time. It will be up to the judge though- the same judge he and his surrogates disparage in their daily press conferences
Uh, I think a justice on the USSC, or any spouse really, might have an interest in having members of his family not take actions that would question their impartiality, or ability to do their job.. I think that within most marriages this is understood....and not really an act of misogyny. Good try though.

The jury must agree that business records are falsified, which is the crime. The state must prove every element of that charged crime beyond a reasonable doubt. But to get the felony enhancement, the jury has to agree that he did so in furtherance of another crime. They don't have to agree which crime. I'm sure the DT team requested special interrogatories, so they can make an appellate issue out of that instruction. But my understanding is that the instruction is based on settled NY case law. On what basis do you think he's railroading Trump? He's ruled against both the defense and prosecution plenty of times. He also allowed Trump to violate the gag order more than 10 times without making him spend a night in jail like any other person would have. Further, he excluded himself in the gag order allowing Trump to publicly disparage him to his millions of followers even though that puts him at personal risk.
