    Ok, no one for a minute believes his wife was making the call on the flag here though. This is just an oaf blaming his wife when he got in trouble.

    I'm sure most people in prison say that but in this case it would because he falsified business records. There's also next to zero chance that he gets prison time even if convicted on all 34 counts.

    My point was not about Trump. It was questioning this idea that the jury doesn’t have to agree on what crime was committed, only that the accused did some kind of crime. Perhaps that’s how the legal system works. If it is that strikes me as sad.

    Yep, non-violent and first time offender (1st time caught anyway) likely wouldn’t get any jail time. It will be up to the judge though- the same judge he and his surrogates disparage in their daily press conferences

    Uh, I think a justice on the USSC, or any spouse really, might have an interest in having members of his family not take actions that would question their impartiality, or ability to do their job..

    I think that within most marriages this is understood....and not really an act of misogyny.

    The jury must agree that business records are falsified, which is the crime. The state must prove every element of that charged crime beyond a reasonable doubt. But to get the felony enhancement, the jury has to agree that he did so in furtherance of another crime. They don't have to agree which crime.

    I'm sure the DT team requested special interrogatories, so they can make an appellate issue out of that instruction. But my understanding is that the instruction is based on settled NY case law.

    I was not shilling for anybody. I was commenting on what appeared to be a legal principal espoused by that poster. I find that principle hard to believe. However, I’m not a lawyer and perhaps that is how legal system works.

    I have taken every opportunity to vote against Trump in primary and general elections, so please put away your Rolodex of prejudice.

    On what basis do you think he's railroading Trump? He's ruled against both the defense and prosecution plenty of times. He also allowed Trump to violate the gag order more than 10 times without making him spend a night in jail like any other person would have. Further, he excluded himself in the gag order allowing Trump to publicly disparage him to his millions of followers even though that puts him at personal risk.

    from anything related to the Jan 6 cases. Him and Thomas ar eboth neck deep in it with Thopmas's wife being one of the ones closest to it.

    If he can't take down a flag out of fear of his wife, how will he vote to convict Trump for his role in the Jan 6 insurrection attempt?

    Are you really serious? Merchan didn't hand pick anymore than trumps attorneys did. the selection process is the same for all cases, just like the FBI rules of force are spelled out for every search. No, it wasn't an assassination attempt on trump. the disconnect from reality with the cultists is strong and you continue to prove it.

    one of the most educated, impartial, even-tempered judges on the bench. but I get that he doesn't worship your cult leader so you believe otherwise. I guess you want that unqualified cultist Canon to be next on the supremes as the only qualification that seems to matter is their willingness to support the maga cult

    You know next to NOTHING about Merchan because the trial has not been televised. You are just revealing an ultra bias, which is surprising as you seem an intelligent person. Every person, from the left or right (but not the biased far right), who knows Merchan and/or who has observed the proceedings RAVE about his demeanor, temperament and fairness. The ONLY basis upon which you could make such an ignorant condemnation is if you're among the MAGA crowd who fault him for being a Democrat or his daughter for whatever she's done which is completely irrelevant to the trial. I would have expected such a post from Gatorrick, not from you.
