he was paid 2x what he billed to cover the taxes. nobody, especially djt, pays more than they owe. djt knew he owed more because it wasn't a straight up bill for services.

many are prosecuted for tax fraud. it wasn't a bill for legal services, it was a bill for hush money. can't write hush money off as a tax expense. that is tax fraud

the jury isn't going to like that much. another strike against the defense team. Merchan has been more than patient with those clowns and their client and I suspect that fact will not be lost on the appellate panel

That’s not even a crime on Trumps part. If he was paying Cohen back and agreed to a certain amount and actually paid it, where is the crime.

Cohen and weisselberg negotiated to gross it up to cover Cohens taxes. Where in the charges is this part?
From my understanding it’s all how the checks where labeled.

Claiming a hush money payment as a business expense. Not sure why you are having such a hard time understanding that. You cannot expense your hookers and blow

Once again show me where that’s happened. Cohen decided to cover with his own money and then Trump reimbursed Cohen right?

I don’t even know where the prosecution has even stated paying for the nda with business funds is a or the crime.

    Can you share that info?

He claimed it as a business expense on his taxes. Do you really think that the DA, the grand jury, the judge, and all those high powered attorneys missed the fact that there was no basis for the charges?

You are wasting your time trying to explain this to him. I tried multiple times. He is simply intellectually incapable of understanding or he is such a Trump sycophant something prevents him from doing so. It's also possible he's just screwing with people and this is his idea of a joke.

Again there is no law even today that prohibits a business for paying an nda.

That’s not what Bragg is even trying. They are going after Trump for “mislabeling” the checks.

You tried what? I asked you to show me where NY law prohibits a business from paying an nda. Yet you show nothing and claim you tried to explain. What a joke.

In fact, NY law doesn’t specify or limit who or what can pay an nda. They now have limits on nda for things like harassment or discrimination but they have never added or amended to change who or what can pay an nda.

Try to focus on what Bragg is actually charging here.

if you did your taxes and wrote off all the costs of your personal vacations as a business expense, would that be against the law?

a business can pay a nda, that is not against the law
a business cannot claim a nda as a business expense on their taxes, that is against the law.
    do you understand the difference?

First, now we are talking about tax law which has nothing to do with this case. Second, it was not until 2017 via the Tax Cuts and Jobs Act that made it so that a business could not write off an NDA as an expense if associated with sexual harassment which still doesn't apply to this case.

Not sure where you are going with this.

Wrong again. First, NY state tax law doesn't even cover anything regarding NDA and generally follows federal tax law. As stated above, federal tax law does not prohibit a business from expensing an NDA unless very specific to sexual harassment.

    26 U.S. Code § 162 - Trade or business expenses

Na wouldn’t be much help. We were just covering tax law. Trump being being charged for falsifying business documents (labeling checks as retainer fee) which has to be tied to another crime of which the judge has said does not need proof a crime was committed but just an intent to. What to me is really crazy is his jury instructions state they can find any crime, doesn’t matter just find one. I’m not sure if that changes after the defense rest… we will see.

He is a relentless and fully brainwashed regurgitator of everything MAGAt world comes up with to defend Trump. He was one of the first ones running here to claim election fraud because there was film of Georgia election workers moving boxes around. He's not to be taken even remotely seriously.
