In fact, NY law doesn’t specify or limit who or what can pay an nda. They now have limits on nda for things like harassment or discrimination but they have never added or amended to change who or what can pay an nda. First, now we are talking about tax law which has nothing to do with this case. Second, it was not until 2017 via the Tax Cuts and Jobs Act that made it so that a business could not write off an NDA as an expense if associated with sexual harassment which still doesn't apply to this case. Not sure where you are going with this. Wrong again. First, NY state tax law doesn't even cover anything regarding NDA and generally follows federal tax law. As stated above, federal tax law does not prohibit a business from expensing an NDA unless very specific to sexual harassment. 26 U.S. Code § 162 - Trade or business expenses

Na wouldn’t be much help. We were just covering tax law. Trump being being charged for falsifying business documents (labeling checks as retainer fee) which has to be tied to another crime of which the judge has said does not need proof a crime was committed but just an intent to. What to me is really crazy is his jury instructions state they can find any crime, doesn’t matter just find one. I’m not sure if that changes after the defense rest… we will see.
