I'm not going to bite (pun intended). Noem will still be more popular than Kamala should she be Trump's VP and Kamala did far worse things to actual humans as Attorney General of California. Arguing semantics as to whether a locale has a "duty of care" is beyond dumb, as is the OP of the thread. And then there are some of us getting played by the Democratic machine as they are already in full-on hedge mode for Kamala's presence on the 2024 ticket.
Was an aside, but I thought an interesting one. I was biting on the assertion that a city that doesn’t kill known dangerous dogs would be ripe for a major lawsuit. While I admittedly haven’t gone looking for decisions on dog bite cases against local governments, I doubt the city would have liability - that seems very similar to the “failure to police” kind of claims that fail because sovereign immunity generally blocks negligence claims for core governmental functions and a local government ordinarily doesn’t owe a duty of care to any particular individual in that context.
You're most likely correct. The liability would probably be more focused on the owner if somebody wanted to sue over a bite. That said, it obviously still matters or else animal control wouldn't put dogs down. My point was it's a rather thankless task for animal control and they do it all the time without batting an eye. It's a silly insinuation that Kristi Noem hates dogs and she shot her dog because she's a cruel, hateful person. Everybody knows an animal doesn't stick around for long if it's causing problems on the farm. That she made it a point to write about it in her book shows how obviously difficult it was for her emotionally, because most people who kill a dog in those circumstances are hardcore enough to not even give a damn. That she felt it was memoir material perhaps betrays her struggle to detach from it emotionally. But alas, the DNC strikes again. Much ado about absolutely nothing...
