Ouch. Thank God for California! Already sentenced to 16 years ago Harvey Weinstein sentenced to 16 years in prison for Los Angeles rape
This could have relevance to Trump’s defamation verdict in the E. Jean Carroll lawsuit. Besides the fact that they look alike and act alike, both Trump and Weinstein had evidence admitted in their trials though the testimony of other women they had sexually assaulted. There is a whole evidentiary analysis on this issue beyond the scope of this thread. The linked summary of the decision states that was the issue that caused reversal. It states that the decision talked about the higher threshold in criminal convictions, so maybe that is the distinction. But it worries me.
Wow. The justice system is so fair and balanced. I'm so glad that rich and poor alike get the same treatment for committing crimes. SMDH
People should get fair trials regardless of charges but this will be universally loathed. It reeks of “more money more chances” to evade the law.
I would add that Weinstein can still be retried albeit without the testimony of witnesses who testified to Weintein's prior bad acts although the State may elect not to do so considering his age and his California conviction.
How do you keep lawyers rich? Dangle this carrot in front of the commoners. If you pay in enough, we can buy your "justice" too.
Just read the decision. So distressing. Plus Harvey Weinstein’s attorneys say it provides a basis to overturn his LA conviction, because the prosecution reference the NY conviction as evidence. Between this decision and the other serial rapist’s immunity claims at the Supreme Court, yesterday was a dark day.
Ronan Farrow points out how this ruling may also jeopardize the current prosecution has also allowed in evidence of similar uncharged acts. The ongoing hush-money case against Donald Trump, in New York, turns on evidence about acts for which he is not being charged.Trump faces thirty-four counts of business fraud related to a payment from his attorney Michael Cohen to the adult-film actress Stephanie Clifford, whose screen name is Stormy Daniels. But the judge in that case, Juan Merchan, has also admitted evidence of other payments, made by American Media Inc., as the parent company of the National Enquirer was known at the time (it has since merged with another firm, rebranded as A360 Media, and for years has tried to sell the Enquirer), that the prosecution says establish motive, intent, and what it describes as a broader conspiracy to sway the election. This week has been dominated by testimony from David Pecker, the former chief executive at A.M.I., on payments by the tabloid company to “catch and kill” a rumor that Trump fathered a child with an employee and the story of an affairhe had with a Playboy model, Karen McDougal. Should Trump take the stand, Merchan has also allowed prosecutors to ask him about other cases against him: a fraud case in New York against his business and civil suits for sexual abuse and defamation brought by the writer E. Jean Carroll, all of which resulted in rulings against him. What Harvey Weinstein’s Overturned Conviction Means for Donald Trump’s Trial
Certainly applicable to the defeated indicted former president and the attorneys currently representing him. He is retaining some of the best legal representation and is hitting up his sheep-like supporters to pay their fees.
The research is very clear: sex offenders have a very high recidivism rate. If he is what he was convicted of, he will find more victims. Rich, powerful, well connected: let him skate. What bullshit.
If he avoids spending the rest of his life in prison, I hope no one is foolish enough to put him in a position of power and influence to be able to do what he did again. But I think we know how these things tend to go.
Especially in Hollywood. Harvey should just go full porn once he buys and bribes his way out through the "judicial / lol" system. Porn would be a nice match for him, given his proclivities.
I thought his lawyers were shitty leftovers, since he doesn't pay his bills, gets em all disbarred, and has been deemed radioactive by the reputable firms. Now he's got a dream team defending him? ...cant seem to keep up...
I don't know if New York has the equivalent of a Williams Rule or not, but the other acts evidence coming in in Trump's trial is much more probative as to the underlying offense than what came in during Weinstein's trial.
