    End of the day, whether you agree or not about the language, if your employer tells you to knock it off, you continue doing it, and then you go on social media during a meeting to publicly talk shit about your supervisors, you've made your bed and get to lie in it.

    It's very consistent with the progressive view of racism and of racial justice. Indeed, the Supreme Court gutted the Equal Protection Clause by imposing an onerous legislative motive test to disparate impact cases.
    Can't. For-cause protections.

    G-L, Why wouldn’t at will employment for professional level employees apply in this case. Why couldn’t the ACLU send the employee down the road kicking stones, no reason needed?

    Oh wasn't at will. She had for-cause employment protections. They were part of the collective bargaining process between the ACLU and the union representing the employees. Even as an attorney, she was part of the bargaining unit because she was not a member of management.

    edit: Further thought: In that case it seems that the reason given is really a stretch to make a case for the ACLU’s action against her. She might or might not have intended what is alleged but nothing I read in the article indicated to this typical white dude that she had racist intent. We all choose how we react to circumstances and the (perhaps) offended persons chose to feel how they did. Maybe the ACLU should hire some adults next time… on both sides of the argument.

    I hope she wins the case.
    I have little sympathy for her, she seems to have zero clue how to navigate the politics of any office, let alone where she was. I don’t think anyone cares that she was fired.
    But saying you are afraid to talk to your boss about something is racism? That is beyond insanity, 75 percent of the working population would say they are afraid of being completely honest with their boss. And someone can’t simply say “it felt racist” and not be challenged. Anything can “feel” however someone chooses to feel about it, it doesn’t make it a reality, nor is the person who made the comment responsible for how you choose to feel, unless it’s blatant.
    The second reason I want her to win, is the message it will send nationally. If the ACLU can’t win a suit like this, it will send a message to every other company in the country that the pendulum has swung too far, maybe we will finally get back to a sensible balance.
    And third, I used to respect the ACLU. They would fight for everyone’s rights, even when it was unpopular. Even when I disagreed with them, there was a repeat in the intellectual and moral consistency. They stood for something important. The last 10 years they’ve become an arm of the left(and that’s not me saying that, lots of articles from unbiased sources on it and why), maybe this will wake them up to where they are and get them back to what they always were.

    Like I said, they literally represented the NRA two weeks ago. Hell, the ACLU filed briefs in support of some people who had felony convictions who voted for Donald Trump in Florida in 2020 after the state told them they could vote and then tried to prosecute them for it. Like with crime rates, perception doesn't match reality.

    I had already edited the post above to say if they are coming back around to who they are then good. But it’s people much more connected to them and their history than me saying it (and the NYT isn’t exactly some conservative rag making the case) and when you take on thousands of cases a year a few token cases can likely always be found.

    But we will see how this case shakes out regardless.

    Like their stand or not, the ACLU used to stand for something. They were unwavering in their defense of free speech to a fault. They defended the likes of Rush Limbaugh.

    Now their principles take a back seat to identity politics issues. It’s not just me saying this, it is former ACLU leaders.

    I hope she does too, if the ACLU wins the case it would basically be a huge blow to unions and the NLRA. Not sure this has anything to do with ACLU's direction, just them acting like an employer, which is very common with organizations that think of themselves as "liberal" or "progressive." When it comes to employees and unions, they always act very right-wing, wanting to be able to fire who they want and have control. No one seems to go "woke" when it comes to at will employment and hierarchies.

    If someone says they are afraid to talk to their boss, then that is “coded language” for racism? That is a load of BS.

    It appears this is about the dominion of black power over anyone who would dare criticize a black person.

    Now, can an employee get fired for other reasons? Sure. That is fine. If you are going to fire the woman, then at least have a real reason for doing so.
