Florida Supreme Court allows abortion & marijuana ballot initiatives; overturns abortion protections

    To go back to the Florida Supreme Court abortion opinion, it blows my mind that Carlos Muniz, the Chief, signed on to the majority opinion saying the right to privacy does not protect abortion rights. 20 years ago, he said exactly the opposite in a law review article he wrote:
    "The people of Florida in 1980 amended the Constitution to add a right of privacy. At that time, seven years had passed since the U.S. Supreme Court established the abortion right in Roe v. Wade. Already there was widespread acknowledgment of the vulnerability of any right that lacked explicit support in the constitutional text. In this context, one purpose of the privacy amendment clearly was to give the abortion right a textual foundation in our state constitution."

    I figured he'd concur with his own opinion to try and explain why abortion restrictions overcome the right to privacy. But he really just pretended he never said what he said.

    Pre pandemic most of our net immigration was dimwitted, bitter, nasty pensioners (think corrupt cops) retiring and moving to Florida as climate refugees. The prototypical Trump voter. More recently we’ve been getting well educated, wealthy climate refugees sufficiently mobile to work where they like. These are definitely not tRump voters. Hopefully a lot of them moved here.

    Am I understanding it correctly, that, if both measures pass, a woman will be required to be stoned on her ass when she gets an abortion?

    If I ever have to read a Supreme Court decision - state or federal - I'll die a happy man. I'm having hives just from reading the tortured dissents in the ballot initiative case.

    You could have left off the first two sentences and still made your point. Personally, I'm not too fond of snarky generalizations.

    But these particular initiatives are solely in Florida. And it won’t make a lick of difference in Florida to the general election. Every state will need to have similar ballot initiatives to drive voter turnout.

    I am far more worried about the independent and Democrat turnout than you. Republican voters will vote in the same numbers they always do; they’re generally consistent. Biden will need huge turnouts for him to win- he had the turnouts in 2020 (Hilary did not in 2016), but Biden is not a popular candidate anymore. I think most voters prefer someone else and generally speaking those who vote for him will be voting against Trump, not for Biden.

    Careful what you wish for. Elected trial judges do not provide the best talent pool. It’s a horrible process.

    What we need is a process whereby judges are selected by a non-partisan committee based in merit-based criteria.

    We already have elected judges in Florida (they are non-partisan elections), just not at the highest levels.

    I was only speaking for Florida and I think it's great news. We will have a chance to get some of these right wing terrorists out of Tallahassee

    I know exactly what I'm wishing for. We used to have merit selection. We now have partisan hack selection. I'll choose elections over that. And I believe the people of Florida will too if given a choice. It's an imperfect method, but there are at least consequences to being far-right crackpots when you have to run for reelection. Wisconsin is the perfect example of this.

    I believe popularism is the worst method for selecting a judge. And partisan selections are even worse. That’s why there needs to be a selection by nonpartisan committees based solely on merit-based criteria. We need to completely eliminate politics from the judicial branch.

    That's not possible, no matter the method. Politics are inextricably entangled in what they do. You want what you believe is the best method. That's fine. But I don't see it as a realistic option. That's why I am supporting the less bad of the possible options.
