Florida Supreme Court allows abortion & marijuana ballot initiatives; overturns abortion protections

    Find an abortion initiative since Dobbs that hasn't driven voters.

    Of reaching 60% or actually becoming law? If it comes to reaching 60% then I would say marijuana. For actually becoming law I would say marijuana but with a ton of caveats. The abortion ballot will be really close. I say anywhere from 58% to 62%

    I'm not concerned about the conservative base. They've yet to show up in enough numbers in any of the other states

    I'm going in the opposite direction here. I think the abortion initiative will do better than weed.

    To a degree. I also am skeptical they'll enforce Fair Districts the way they're supposed to.
    In a better place? Sure. But what scares me is if a case goes to them, they could easily just say, "Oh, strict scrutiny applies, but protecting unborn life outweighs this right. State wins under these circumstances."

    I think marijuana runs ahead of it by at 5%, if not more. It doesn't feel like a very polarizing issue anymore, even if there are a solid number of olds who still oppose weed.

    Even if they find a way to weasel out of it, that would probably make Republicans even more unpopular, so it still serves a purpose. Plus having those two initiatives on the ballot may be enough to put FL in play for the presidential election.

    It will, at the least, make FL more expensive for the Rs. They will have to work a little harder for FL and spend more money than (maybe) anticipated.

    The Florida Court SystemCounty and circuit court judges are elected. District court judges and Supreme Court justices are appointed by the Governor. However, when a judicial vacancy occurs on a county or circuit court, the Governor appoints a successor. google...

    We'll see. I think the pro-choicers will be the more fervent of the two, especially with the 6 week fake heartbeat ban going into effect in May.

    OTOH, the opposition to the abortion initiative has a well organized machine already ready to go whereas it seems MJ has gained a widespread acceptance across a lot of demographic categories.

    Pre Rick Scott (maybe Jeb,) when probationers were completeing their probation the PO's had a form entitled "Automatic Restoration of Civil Rights" that they would help the probationers complete and submit. That got them their rights to vote and run for office back...nothing to do with firearms. Then it regressed to the point a constitutional amendment had to be passed.

    2020 was 51 - 48 Trump. Could those issues move the needle 3 points? Maybe. The good news is those issues are good for mobilizing suburban women and young people who lean towards Biden.

    Other question is going to be seeing what Florida looks like generally now and whether DeSantis’s reelection romp was an outlier or if Florida has actually shifted markedly red since the 2018/2020 cycles.

    My personal view is that we should put a ballot initiative on the ballot in 2026 to move to nonpartisan elections for all state judges, including the Florida Supreme Court.
    That was the part that enraged me. It was beyond disingenuous for the Eleventh Circuit to rule that depriving somebody of the right to vote based on them owing money was consistent with due process when the state lacked the ability to even tell them what they owed to get their rights back.

    There’s no doubt FL is moving red but DeSantis jumped the gun. I think FL voters saw him as a mostly pragmatic Republican in 2020, but then he went full religious right/ MAGA.

    Not only that, but there was a group that was going to help people pay their outstanding fines and costs, obviously with no idea how they might vote in the future, and AG Ashley Moody threatened to go after them.
