First and even second dui’s in fl are misdemeanors unless there are extenuating circumstances. Serious bodily harm, death, crazy high bac, etc. Second one does carry a mandatory jail sentence if it happens within 5 years of the first, but can usually get house arrest. It’s generally not upgraded to a felony unless it’s attached to other charges, or habitual.

 

I doubt it will be that severe.
