Undocumented is a better, more accurate term. The person who killed Riley was certainly undocumented, but there's a question whether or not he was here legally or not. Trump extended an 18-month no deportation referral for those entering from Venezuela. Ibarra entered some time in 2022, but exact date hasn't been released as far as I know. But if it was within the 18 months, then he technically was here legally, but without documentation. Here legally without documentation also would describe all those waiting on asylum hearings, for example.
Interesting. The way I read Trump's Memorandum, it seems to exclude Venezuelans who were not continuous residents since January 20, 2021? Even if Trump's action did not apply to Ibarra based on when he arrived (one article I read said September 2022 but not sure if that has been officially confirmed), it seems fair to point out that the Trump administration was so supportive of deferring the deportation of Venezuelans in the United States that it cited an ongoing national security threat and the safety of the American people as grounds for the executive action. I know there were many in Florida, in particular, who were proponents of such action. I wonder if there any Venezuelans who were clearly covered by Trump's decision that killed or victimized Americans, and if so, whether people think Trump should get the blame for not deporting them? The memo covers new arrivals. Ibarra didn't reside in the US until 2022. There's a question about his criminal past, which may have made him ineligible for the deportation deferment. But if I read the memo right, if Ibarra didn't have a felony past, and arrived from Venezuela in Sept 2022, and INS didn't deem him a problem, then he was in this country legally, under the Trump decree, when he killed Laken Riley. Therefore, he was not illegal. Undocumented? Yes. But not illegal. And a note to Seal Clubbing Skippy (95), here's a little education on the terms undocumented and illegal.
