Hundreds of J6 Cases Could Be Shortened in Massive Court Win (townhall.com) Circuit Judge Millett ruled that interference with Congress’ certification of the presidential election in 2021 does not apply to an extension of a prison sentence. The U.S. Court of Appeals for the D.C. Circuit ruled that defendant Larry Brock must be resentenced. Brock was a retired Air Force colonel who was sentenced to two years in federal prison for protesting in a building on J6. Several other parts of Brock’s conviction were upheld as well. However, the appeals court ruled it would “vacate Brock’s sentence and ordered the district court to resentence the single ‘interference’ charge.” The 3-0 decision could force D.C. district judges to reconsider and shorten the sentences other hundreds of other peaceful protesters. About time we start to get some judges with common sense
Sounds like your kind of dude: According to the government’s evidence, Brock – a retired Lieutenant Colonel in the U.S. Air Force – was among rioters in a mob that illegally entered the Capitol grounds and Capitol Building on Jan. 6, 2021. Brock was wearing a tactical vest and had a helmet. He entered the Capitol at approximately 2:24 p.m. through the Senate Wing Doors. He moved through various areas of the building, including the Crypt and Rotunda. While in an area near the Rotunda Doors, he picked up a discarded pair of plastic flex-cuffs and kept them while in the building. Brock entered the balcony of the Senate at approximately 2:43 p.m. He then moved downstairs and entered the Senate Chamber about five minutes later. He walked around the Senate Chamber for about eight minutes and, during that time, he rifled through paperwork on Senators’ desks. He then exited the Capitol at approximately 3:01 p.m., 37 minutes after he entered. Shortening their sentences would be fine, as long as we deport them. They clearly don't love America or want to be here. And they're a criminal threat. We can't risk ONE more person being hurt by this group that has KNOWN criminal tendencies!

To be fair, it IS a thread celebrating reduced sentences for people who attacked police and desecrated our Capitol, in service of a man who was orchestrating a conspiracy to have a legitimate election not certified. So some of the comments may be appropriate.
I'm sure City's depiction of the evidence against this guy is accurate. I fail to see where he attacked any capital police or any evidence of him desecrating our capital. Did he go where he should? Well, yes. Does he deserve some punishment? Well, yes. Is he an ant- American insurrectionist? We may have to disagree. Did he stop the transfer of power? Ask President Biden that!
Wasn't she indicted after she urged her supporters to attack the Capitol to prevent the certification of the 2016 election? She is also probably the first election denier to concede that she lost the election. Unless I missed it I have yet to see a similar announcement from Trump and it's been over three years since the the 2020 election was called for Biden or even certified by the majority of state legislatures. Since you may not have seen although I posted it several times in the past on this board.
Getting back to the subject of this thread. Let's keep in mind that while the court reduced their sentences, their convictions have not been reversed or vacated. Brock and the other J6 insurgents are still as guilty as hell of the crimes with which they were charged and convicted.
I remember this guy in his gear now that I looked him up. It appears that he was convicted of six crimes and the Court upheld each conviction but reduced the sentence for one of them. I assume he was serving the sentences concurrently and wonder how long the sentences were/are for the other crimes? I'm not sure it's really a great day for him depending on those answers. Having said that, the Opinion indicates that he was actually trying to calm down some others in the mob. I certainly think whatever sentence he got/gets should reflect the relative severity of his conduct compared to others even if his being a retired officer in the Air Force makes what he did more disappointing.
