    Interestingly, the 5th Circuit reversed the conviction of a man under Section 922(g)(3). Looks like it's on appeal before SCOTUS. From the 5th Circuit Opinion:

    American history, laws have regulated the combination of guns and intoxicating substances. But at no point in the 18th or 19th century did the government disarm individuals who used drugs or alcohol at one time from possessing guns at another. A few states banned carrying a weapon while actively under the influence, but those statutes did not emerge until well after the Civil War. Section 922(g)(3)—the first federal law of its kind—was not enacted until 1968, nearly two centuries after the Second Amendment was adopted.

    In short, our history and tradition may support some limits on an intoxicated person’s right to carry a weapon, but it does not justify disarming a sober citizen based exclusively on his past drug usage. Nor do more generalized traditions of disarming dangerous persons support this restriction on nonviolent drug users. As applied to Daniels, then, § 922(g)(3) violates the Second Amendment. We reverse the judgment of conviction and render a dismissal of the indictment.

    With all the voluminous criminal and civil charges, appeals, impeachment and misconduct hearings, lawsuits, and other legal wranglings that jam-pack the news, I'd say it almost takes a genius to be a good lawyer nowadays. My hat is off to them. (Even though I still enjoy jokes about lawyers.)

    And I found a Bureau of Justice Statistics report that answers my earlier question on how common controlled substance prohibited persons prosecutions are.

    We’ll start by noting that roughly 75% of investigated prohibited possession cases are actually prosecuted.

    From 2000-2016 the total of all prohibited person possessions investigated was 139,431 suspects. As I suspected, the vast majority (90% of those) are felon in possession cases. The second most common was undocumented immigrant in possession (4%). And the third most common (2.7%, or 3,695 people) were unlawful users of or persons addicted to controlled substances.

    Yes, it’s ordinarily much harder to prosecute (and thus much less likely to be prosecuted) than felon in possession. That’s why the advice is don’t do things that make it easy to prosecute you for it (for example, if you have a concealed weapons permit, don’t go get a medical marijuana card - if DOJ ever got access to both databases and could compare them, they’re most of the way to proving it already for everyone that overlaps between the two databases).

    Similarly, if you’re going to go buy guns from an FFL and complete a 4473 for it, don’t also write a book about your cocaine addiction.

    I don’t have a ton of patience for the idea that we should simultaneously be advocating a bunch of new gun laws, but also refusing to prosecute existing firearms felonies (at least when they’re committed by the children of prominent politicians).

    Renounced U.S. citizenship (11 cases, which doesn’t register as any percentage when using one decimal place)

    ATF has amended Form 4473 a few times to add a disclaimer on that question that says, in bold, a reminder that marijuana remains unlawful under federal law irrespective of its state legal status.

    Theoretically having a card in and of itself is not disqualifying, but good luck trying to convince DOJ if they ever got their hands on it that you have a marijuana card but do not actually use marijuana.

    This is definitely one of the things that federal marijuana law needs to be amended to fix.

    I sure hope Comer and Jordan are investigated to determine what they knew and when. Were they aware all along that this source was bogus and feeding information from Russian intelligence? Were they hiding behind the FBI for plausibility deniabilty or were they genuinely duped? I wouldn't be surprised at all to learn that they knew the truth all along.

    If they knowingly acted as conduits for Russian disinformation in an effort to impeach the President that doesn't seem too far off from treason. It may not fit the legal definition but feels like it should.

    They are looking more like Putin collaborator's than representatives of the US. Preventing Ukraine aid from going through, spreading Russian disinformation, impeaching a President without evidence of any wrong-doing, and conducting business behind closed doors where the public cannot see the evidence/lack of evidence for themselves. It follows Trump asking Zelensky to just say Biden was corrupt without any evidence and he would do the rest - or have integrity and lose military aid or taking Putin's words over our own Intelligence agencies on the national stage. Trump is perfect for driving the Russian wedge into the US, he can con the MAGA crowd just like he conned people over charities, universities and business dealings. Now with his financial jeopardy, he is even more susceptible to compromise.

    So we are now back with the laptop and all this stuff was Russian? You know it was all a Russian plot a few a years ago, then it actually wasn't. but now it is again?
    I guess some will believe anything they are told to believe!!

    Prosecutions for Hunter Biden's specific charges are not common. If you throw in prosecutions for convicted felons purchasing firearms, it completely skews the numbers for obvious reasons.

    In an odd and ironic twist of fate it looks like the current and somewhat bizarre reinterpretation of the 2A might very well provide a defense as @mrhansduck noted above.

    Case in point. You aren't addressing the actual evidence of the case, such as the guy who provided the information admitting to his contact with Russian intel agents, but rather trying to cutely dance around it, as you were the told that this wasn't true and very much want to believe that.
