    My first jury trial was as a prosecutor on a misdemeanor trespass case. I had just been promoted from juvenile division (no jury trials allowed) and sent to the Plant City office, the only prosecutor there. When I asked my supervisor for assistance, he sent me a printout of voir dire questions. I was hoping for another attorney to second chair me, I got 2 pages of questions. Two minutes in during jury selection I asked a women on the perspective jury panel how long she had been a Tampon. It took me a second to figure out why everyone was laughing. It did not go well that day.

    Nothing. There have frequently been married or dating couples in our State Attorney's office and there is zero prohibition to them working on cases together. At one time our elected State Attorney was dating one of his prosecutors.

    The argument the Georgia defendants are making is that Wade spent some of the money he was paid taking Willis on vacations, etc. and that somehow creates a conflict.

    She's relatively articulate, but her knowledge of the law is very questionable, her knowledge of evidentiary matters is abysmal and she is clueless as to proper courtroom etiquette and procedures. It goes beyond a simple lack of experience. Dumb? No. Really bad lawyer? Absolutely.

    Trump should have hired her to be the face in front of the camera, but not given her ANY responsibility as to legal matters.

    It is scary to think how stupid you have to be to be taken in by this new BS from the Trumpers.

    Who cares if two people on the exact same side of the case are having relations?

    It would be a scandal if say Willis was having an affair with someone on the Defense or the judge.

    Otherwise, it is just more BS he is throwing at the wall knowing his un-educated followers will believe it shows he is being treated unfairly.

    Another oopsie by Habba, this time a double oopsie.

    During opening statements, Habba told the jury that victims of defamation have an affirmative duty to mitigate their damages and that not only had Ms. Carroll failed to do so, but that she had actually exacerbated her damages.

    That struck the judge as odd (and with good reason,) so he ordered the lawyers to brief the issue. The briefs are in and wow.

    Oopsie #1: Under New York law, the victim of defamation has no duty to mitigate damages, Habba grossly misstated the law. She argued case law in her brief that supports the proposition that people who are injured or have their property damaged have that duty. For instance, if you break out my car window and I don't get if replaced or at least garage my car, you are not responsible for my car getting flooded by a bad storm or someone stealing its contents several days later. Habba failed to even acknowledge the well settled, controlling NY case law that victims of defamation with malice have no duty whatsoever to mitigate.

    Oopsie #2: Pretending for a second that such an affirmative defense existed, Habba NEVER raised it in any of her pleadings and, therefore, waived it. If you don't properly plead an affirmative defense...*poof*..it's gone.

    She has no business being in that courtroom in any capacity other than eye candy.




    Edit: Habba graduated from Widener University Delaware Law School in 2010. That law school is currently ranked #175 in the country.

    For comparison, UF (Levin) is ranked #22.

    This is what happens when you constantly screw over your lawyers. Trump is scrapping the bottom of the barrel and it shows.

    I agree with Sarah Huckabee Sanders that Trump brought back "patriotism and love of country".

    Just not for the United States of America. Maybe for the Confederate States of America. Or Russia. But not the United States.

    “Do your own research” sounds like something our resident Trumpers here like to say. That guy is lost on the sauce, sad that he and many Trumpers refuse to speak to their family who have completely different views because they are so invested in the cult of a guy who wouldn’t piss on them if they were on fire.
