    Mayor Adams announces $708 million lawsuit against charter bus companies bringing migrants to city

    NEW YORK (WABC) -- "New York City Mayor Eric Adams has announced a lawsuit against 17 charter bus and transportation companies carrying migrants to the city as it continues to deal with the ongoing crisis.

    The city is seeking $708 million to cover the costs incurred over the last 20 months for providing emergency shelter and services to migrants transported by the charter bus companies."

    If anyone is responsible it would be the federal government and their lack of control of the border.

    It makes sense. Cities have bus depots and port authorities.

    If they are circumventing the laws and not going through proper channels with these “chartered” buses, there might be ways to fine them for operating unlicensed and undescheduled.

    Of course, there is a funding bill to "try" to enact more "border control "

    The federal government didn’t operate the buses. Unlike the federal government or even the states, the bus operator is subject to the jurisdiction of any state they are traveling to or through.

    The buses are problematic on multiple levels. Considering the reports of how those Desantis ordered buses lied and misled to get passengers on board, one could make the argument those bus operators and certain political operatives are in fact running a criminal human trafficking ring. Even as a political stunt, if you use deception to lure the immigrants onto buses you are very likely committing a multitude of crimes. Considering I think they should be looked at criminally, the prospect of fines should be the least of their worries.

    I was referring to the early Martha Vinyard bus specifically. I mean, as I recall, they named the female political operative who did it and even had an example of a fake pamphlet and promises that lured them on. Also interviewed several of the immigrants after they arrived and all claimed they were promised jobs. Didn’t seem much to dispute that they were lied to, but if you would rather believe a politician then you do you.

    I actually have no issue with disbursing immigrants all around the country. But it shouldn’t be done in the middle of the night or without coordination at the destination. When you do it unannounced at best it can only be a political stunt designed to create chaos. The bridge from political stunt to criminal isn’t a long one once you take the path of deception.

    If nothing else it may make the bus companies hesitant to further engage in Republican governors stunts.

    A modern day variation of greyhound therapy: shipping those " problem people" somewhere else without making any arrangements for what happens at the other end.

    Your graph won't convince those responding to the "Biden's open border" dog whistle. They'll just say more apprehensions are merely a predictable consequence of an open border. A better graph would track the number of people entering the country illegally per year over several presidencies.

    The Commerce Clause allows for the movement of people and goods across state lines.
    The Mayor won't win in a federal court of law.

    "While most discussion surrounding the Commerce Clause revolves around the federal government, it indirectly also affects state governments through what’s known as the Dormant Commerce Clause. The Dormant Commerce Clause refers to the prohibition, implicit in the Commerce Clause, against states passing legislation that discriminates against or excessively burdens interstate commerce. Of particular importance is the prevention of protectionist state policies that favor state citizens or businesses at the expense of non-citizens conducting business within that state. For example, in West Lynn Creamery Inc. v. Healy the Supreme Court struck down a Massachusetts state tax on milk products because the tax impeded interstate commercial activity by discriminating against non-Massachusetts citizens and businesses".

    The suit is about recouping costs, not whether they can do what they are doing constitutionally

    And the lawsuit won't stand up in a federal court of law.
    The bus companies are only facilitating interstate commerce.

    A mental hospital in Nevada got in legal hot water for using greyhound therapy to ship mentally ill people to distant cities with no arrangements for access to resources at the other end.
