While possibly true, she's the one that initially battered him. So, she really doesn't have much to support any charges against him.
I will let the following speak for itself about whether it was cruelty to animals or just a “big chain on a dog”: I would be more inclined to believe that Cook was misidentified (you know, racially, by the victim and her friends who were also black) if Cook was not part of a pattern of misconduct that included at least one more incident of violence against a woman in 2020. But then again maybe his girlfriend also racially misidentified him. Symptom of COVID brain or the like. I would also be more inclined to believe that story if, as you hint at, the TPD had charged Phillips at some point. Believe what you like. The jury clearly bought it. Hell, one juror scoffed at the notion the victim was punched at all. In his expert opinion, she fell or something. So Phillips was off the hook in any case. Correct. In my experience, that is not so. Not sure what the specifics of Florida law are on the matter (perhaps one of our lawyers can weigh in), but the concept of “primary aggressor” might be in play here. If it is, then it’s important to understand that the primary aggressor is not necessarily the one who instigates the fight or even hits first but the party who has the ultimate power in a physical altercation. That’s why in the overwhelming number of male-female fights, especially domestic situations, “I just hit her back” is not much of a defense.

If he instigated the entire action, then yes, I suppose he was, but once he was being restrained, she took advantage of that to hit him in the face with her fist, not only that, but she covered a wide distance to do so. That's about as aggressive as one could be.
I’m just telling you that the law may not come down to what you think is fair. She may have done that, but if when he got loose he did more than what he needed to physically put distance between himself and her, then he may have broken the law. The law only allows for force necessary to defend oneself, not whatever the man thinks is a fair and proportionate reprisal for whatever the woman did. But you are we kidding with this hypothetical?
