Yes, that is problematic for sure, but IF that was the measuring stick for being fired with cause, then a lot of people better be updating their resumes.

LOL. Yeah, not buying it. 27+ times at an avg of 30+ minutes a call? Come on, no guy in the world is doing that unless he's in a relationship with that person.

"...she alleged him of making sexual comments about her over the phone and masturbating without her consent....."

One needs someone else's consent to masturbate??? Who knew...

    LMAO!

Are there many jobs where you can spank it on company time and not get fired? I must be in the wrong line of work.

You keep talking about his perspective ... maybe he thought it was a relationship and maybe she thought it was a consulting job.

I have a couple clients that I hate to call because I can't get off the phone with them, the work stuff takes five minutes but then they want to tell me their life story (again) and will talk for 30 minutes about nothing while I keep trying to politely get off the phone. Maybe one, or both of them, are like that ... I bet she was happy to have a line to coach who she thought was listening to her and taking her seriously...

Yeah, I'm not sure it's really material, except within the context of sexual harassment and Title IX. I believe she was conflating her rape (non-consensual sex) experience, with the obvious discomfort his behavior--which really comes down to his declarations to her-- caused her (IOW, it wasn't the fact that he rubbed one out while on the phone with her (how could she know?)--it was the audacity, rudeness and stupidity, of telling her about him doing so (and why would he do that, but for the reaction it was intended to illicit?).

The University said as much in its Notice (of For Cause Termination):

It is immaterial if, as you allege, these actions were purportedly consensual and somehow occurred outside of your workplace. As the university previously stated, 't is decidedly unprofessional and unethical to flirt, make sexual comments, and masturbate while on the phone with a university vendor.'

...Had you not engaged in this inappropriate and unprofessional conduct, the university would not be subject to public disrespect and ridicule regarding your actions.
Note the "cut & paste" job from the contract:

Tucker has a clause in his contract that states it could be voided if he is convicted of a crime or engaged in “conduct which, in the University’s reasonable judgment, would tend to bring public disrespect, contempt or ridicule on the University.” In adherence with a clause in Tucker's contract, Michigan State notified Tucker on Sept. 18 that it intended to fire him for cause.

Good reply. MCH ST’s response is alot more reasonable within that context

Stop with the half truths ... he called her at midnight ... that's the time he admitted he was masturbating on the phone, and it was the last time they ever spoke.

You make it sound like they did this often and she was okay with it.

Edit: That was actually the second to the last time they spoke. He called again to complain that she was gossiping about him.

She texted him to wish him happy fathers day a month later LOL.

Half truths? Did he or did he not have a conversation with her at midnight? We both know the answer. They were in a relationship and she got pissed when he broke it off. I believe the quote is "hell hath no fury like a women scorned" applies here.

Neither you nor I know if they did this more than once. Let's see when the text messages are ultimately revealed who's right.

Possibly, but still married. By his account, the relationship began in the summer of '21. He said that, at that time, they had been separated "a long time." Yet, she was by his side when he took the job in February the year prior. Presumably there's plenty of he said/she said for what led to their falling out, but I don't think one can claim to be surprised that an extra-marital relationship might be looked down upon by an employer, particularly given the mentioned clause in his contract.

According to her, she told him multiple times she wasn't interested in dating him, and even has text messages to friends saying she thought he "liked" her but she told him they are just friends and she didn't want to be a part of his divorce ... you keep saying they were in a relationship, and they meet several times in person for work related events, it appears ... did they ever kiss? Have sex? Declare themselves an item? He's not even claiming that. Were are you getting "they were in a relationship" from?

I immediately thought the topic was about a sex call between Tucker Carlson and his lover Trump. I was like oh boy, “MAGA boys are gonna be jealous”

but seeing that it’s about Mel Tucker, it’s unfortunate but he put himself in a compromising position and made it easy for Michigan State to can him.

There's reasons to fire and there's reasons to keep; both are part of the measurement. Naturally some ADs will overlook "reasons to fire" if the "reasons to keep" have a greater presence...which is a separate issue altogether.

No one talks to anyone at midnight unless you are in relationship. Good try.
