Sheriff in New Mexico’s most populous county rejects governor’s gun ban, calling it unconstitutional

    I think it's time for We The People take matters in our own hands becasue the lawyers in robes (judges) will let these elected clowns at least think that they can take our Constitutional right away from us for any made up excuse that can invent.

    The sheriff in question is also an elected official and has the right to force this into the courts with the Constitution on his side while on the higher higher ground. He stopping this naked power grab from the governor, and he's forcing the governor to plead her case to the SCOTUS, eventually, while maintaining the rights of the people there in the Constitution during the process.

    She is going to loose that that has to be made loud and clear... If I were the Sheriff, I would sue her and call for a recall vote while waiting for the slow-motion court system to undo her illegal "edict."

    Except you are fully ignoring the history of the 2A and how it was ultimately applied to the states.

    I struggle with what the right choice is. You said, "I'm not sure a Sheriff is left with much choice." There's a difference between the two.

    If you struggle with what the right choice is, then why take sides? You seem certain the sheriff is wrong.

    Do I? I think encouraging sheriffs to decide what is and isn't constitutional is problematic. That's not within their competence. But I also don't think sheriffs should vigorously enforce obviously unconstitutional laws. So yes, it's a tough question. I'd say the right answer is probably for a sheriff to say nothing, not prioritize enforcement of the law, and wait for a court decision.
