Georgia judge let’s all white Trump defendants go, jails black guy

    I do not know that. I’m surprised you are saying this.
    I watched CNN during the last two elections. Their top anchors were all super libbie, didn’t hide how they wanted it to end up as the state elections finished up.
    Fox has very good people for the big events. Brit Hume, Bret Baier, Martha Mccallum are very good conservative newscasters.
    There are a few others that I find fair and act like adults.
    CNN is no better than FOX.

    Fox settled with Dominion Voting Systems in the amount of $787 million for promulgating a false narrative. Unless one includes Nick Sandmann's lawsuit against CNN which was settled for an undisclosed sum, most likely around $50,000 there is no equivalence between the two networks.

    Liberals own the air space for media.
    GTFO trying to tell me CNN is legit objective.
    Fox has some pretty tilted shows each evening that isn’t supposed to be news.
    5 pm with Bret Baier is good news.

    CNN is guilty of liberal bias, 100%. But there's a difference between bias and propaganda.

    And like Chris Wallace before him, Brett Baier lends credibility and authenticity to FoxNews as a channel, and by extension to the evening shows that "aren't supposed to be news" but that a majority of viewers consume as though it is factual reporting.

    Absolutely. And while Fox does report the news most of its viewers do not watch the network for its news shows. They watch it for its prime time infotainment shows and believe that that the opinions of the likes of Laura Ingraham, Sean Hannity and previously Tucker Carlson are the news. In fact, there are have been occasions on which Fox has accurately reported the news and its own viewers refused to believe it. On those occasions its viewers have abandoned Fox for more right-wing networks like OAN and Newsmax.
    Fox even fired some of its own executives for accurately reporting the results from Arizona of 2020 presidential election.

    Fox biz also has some good people I trust.

    Perhaps, but there are people/platforms that have at least tried to objectify the extent of media bias and integrity. This source shows MSNBC slightly higher in integrity of factual reporting (CNN much higher) and Fox News slightly more politically biased.

    I would assume by now, Gatorrick22, you are as tired of me correcting you on the law as I am having to do it.

    Yet you persist with statements like those.

    When a legal issue such as this arises, there are at least two distinct possibilities.
    1. The judge and lawyers go by gut feelings and wing it.
    2. The judge looks to the law and/or applicable rules of procedure and goes by that.

    We butt heads because you invariably go with the former, while I look to the later.

    So let's see, this happened in Georgia, so let's try a Google search for "Georgia law bail determination" just for grins. Low and behold, the third thing that pops up in 0.46 seconds is a link to. :

    Georgia Code Section 17-6-1

    That looks promising. Scrolling down to subsection "e" we find the following.:
    1. A court shall be authorized to release a person on bail if the court finds that the person:
      1. Poses no significant risk of fleeing from the jurisdiction of the court or failing to appear in court when required;
      2. Poses no significant threat or danger to any person, to the community, or to any property in the community;
      3. Poses no significant risk of committing any felony pending trial; and
      4. Poses no significant risk of intimidating witnesses or otherwise obstructing the administration of justice.
    OK, that tells us that Georgia, like every other damn jurisdiction in the country, including Florida, looks to the danger to the community, etc. the person poses, in addition to flight risk.

    Does Mr. Floyd present as a danger? Well, guess what? We have access to the affidavit filed in his pending criminal case, full of quotes as the FBI agents were wearing recording devices and Mr. Floyd, known to be a former Marine and professional MMA fighter, unfortunately opted to voice some of his threats to the 911 operator when he called the local police on the FBI agents. The assaults occurred after Floyd had been served with a Federal grand jury subpoena. The FBI agents were exiting his apartment building when Floyd thought it would be a good idea to exit his apartment, chase them down the stairwell and chest bump one of the agents twice. Floyd told the 911 operator in a recorded call that "They were lucky I didn't have a gun on me, because I would have shot his (redacted) ass." Horseplay with the FBI agent? Harmless banter with the 911 operator? Or someone who poses a threat to others? Kind of hard to fault the judge for making a finding that statutory provisions 1.B and/or 1.D existed, especially 1.D as these FBI agents were legally serving him a subpoena in a related matter.

    Well, it certainly looks like the Georgia judge was on to something when she made her ruling, so no to, "He must be released on bail." There is no requirement for conviction of a violent felony, merely that the person poses a significant risk.

    The informed optics here are that the judge was obviously well versed in the law and applied the appropriate statutory criteria to the offender's circumstances in denying bail. It's difficult to predict the optics to those poorly informed as to the law on this issue because they're, well, all over the place in how they look at things...."law and order" one day, "disband the FBI and Justice Department the next." A judge must properly apply the law and not be concerned with how some poorly informed people are going to look at the results.

    Probably a tad bit more to analyze. At least one local news station did a piece about crime in Atlanta and mentioned this judge’s reputation about being soft on crime. I don’t disagree with anything major in your post, but I think your purported conclusion is premature. As you note the judge has great discretion in setting bail under the guidelines, but if we want to know if there are political leanings leaking into her decisions we would have to review her bail history in more details. I suspect this is already underway.

    with all that said, the optics will likely be used against the Dems…even though it may be 100% legit.

    Possibly. Judges are supposed to be apolitical, but then again at the trial court level they have to run for office and there would naturally be some sensitivity to that type of publicity.

    Assuming the allegations are true, however, Floyd went over the top with the FBI agents, not only with his actions themselves, but doing so while being recorded or making that recorded 911 call. Hitting a cop performing his/her duties is wrong, doing so while being recorded and then lamenting the lack of a firearm to shoot the cop to a 911 operator takes it to another level and suggests a mental health issue.

    cops get hit all the time and the Perps get arrested and charges dropped all the time. I am not saying this judge/prosecutor fall into that camp. I know nothing about this judge. The prosecutor is allegedly a political hack, but I have no info to support this. I know little to nothing about the Georgia case because I don’t give 2 Fs. LOL.

    Floyd's case was also complicated by the fact that he said he couldn't afford to hire an attorney but apparently he didn't qualify for a state-provided one. The judge said that's one reason she was leaving bail up to the trial judge.

    I think he could afford to hire an attorney, at least for the bail hearing. That's a no brainer. Whatever debt you have to take out to get a lawyer for that, do it. This case has so much national attention, he could probably have the funds to pay his attorney in a gofundme fundraiser within hours. A little effort to not be stuck in jail is the sensible thing to do, especially if you are worried about your family, as he stated to the court. Given the allegations that he body slammed an agent serving him the indictment papers and based on his reluctance to pay an attorney to be present for his bail hearing, I'm going out on a limb and saying this guy is mentally unstable and unable to make common sense decisions. Who doesn't do what they can to get bail? You can't put a price on freedom, especially if you have a family who depends on you.

    Makes me laugh that at the same time this story was coming out, Trump was bragging online about raising $7 million dollars in a few hours after his arraignment. Meanwhile, his conspirators are begging for financial help for their defense and he's ignoring them. Such a team player.

    I knew there was a reason I’d been switching over to OAN more often as of late. Newsmax has a higher production quality, but as we know, production quality don’t mean diddly squat.

    Willis is a bit of an enigma-she’s used RICO twice before in high profile cases, one against Atlanta teachers in a mass cheating/test score scandal and the other against a group of rap artists in a street gang case. Hardly right wing targets, so I think the allegations of her political hackery are potentially more politically motivated than she actually is. FYI despite your not giving 2 F’s
