I had no idea it was even like this for straights in California. This is unbelievable. What the hell is wrong with California??

Gov. Newsom signs controversial bill into law reducing penalties for sexual relations with minors

    Even California Dems are alarmed:

“I cannot in my mind as a mother understand how sex between a 24-year-old and a 14-year-old could ever be consensual, how it could ever not be a registrable offense,” Democratic Assemblywoman Lorena Gonzalez said when the bill was being debated in the legislature. “We should never give up on this idea that children should be in no way subject to a predator.”

A bill from 2020? Are we rehashing this again? The law already existed and was expanded to include lgbtq+ community

Wiener is a liar. The bill gives judges latitude not to include offenders on the registry if the offender is not more than 10 years the senior of their victim. So now a judge has discretion on whether or not to include a 24 year old who has relations with a 14 year old. This protects child predators. This is abhorrent! Newsom is scum!

There’s nothing to debate. It is what it is. If you support it, then you must think there are certain situations where it would be consensual between a 24 year old and 14 year old. I think that’s insane. Do judges in California not have discretion as to whether or not to include someone who does this on the offender registry list? Yes or no?

Age of consent in CA is 18. So it’s a crime for a 24 to year old to be involved with a 14 year old.

    Unsurprisingly, you are wrong.

There shouldn’t be too much judges discretion on this age scenario, but if there is to be any discretion it shouldn’t be biased against a particular group. CA previous law apparently gave discretion to the judge where there was full intercourse, but NOT where there was oral or “digital’ penetration? The change lines them up. Your own link says the same thing as the fact check.

Discretion probably only comes into play anyway if it’s believed the adult was duped. Not in an actual assault. Like if the minor lies about their age. 24 vs 14 seems to stretch that limit. I think that’s probably too much leeway, unlike say a 17 year old claiming they were 19. But maybe this was based on a case where the prosecution and judges hand was forced?

You're offbase. In Cali it is illegal. The 2020 law did not change that

Who said it did? What it does is gives the judge discretion as to whether or not to put a person who is up to 10 years older than their victim on the registered offenders list. Newsom recently expanded that latitude to protect LGBTQ+ offenders. That is why you see several DEMOCRAT politicians in California sounding the alarm.

It is noteworthy that your side attempts to dismiss these facts with a straw man argument nobody is making.

No worries. Basically, LGBTQ+ advocates were complaining that if say a 22 yo male has anal relations with a 15 yo male, that the judge did not have the option of keeping the 22 yo gay male off of the offenders registry list, but if it had been a 22 yo male and a 15 yo female, said judge would have that option. Newsom signed a bill expanding that option to include anal and oral relations so that LGBTQ+ offenders can get that same consideration from the judge on not being on the registry list.

The obvious problem is why would a judge ever seek to shield any 22 yo who does that? Only in California. The bill also seems to assume that a 14 yo can somehow provide consent in a scenario like this, which is batshit crazy. Only in lovely California.

Person who votes for political party that believes in child marriage and child forced carry of rape conceived births to term wants to talk about pedophilia. Classic.

Leave it to the left to approve of expanding protections in a statute that ought to be called Jared's Law.

I’m not sure which bothers me more. The law as it’s written or certain people on the left attempting to deflect attention from the law and the change Newsom made.
