When the next wave of insurrectionists indictments come— against the coup conspirators who assisted Trump— they should remember who issued the call to arms. The House Select Committee Report did a fabulous job of establishing how Trump’s tweets and earlier speeches energized these people. All sourced. A heavily footnoted report for which the evidence was made available. While much attention is focused on his speech, the seditionists in the Proud Boys had started their attack while Trump was speaking.

A judge in Washington’s federal court heard testimony without a jury before convicting Alan Hostetter, a right-wing activist and vocal critic of COVID-19 restrictions who defended himself at his bench trial with help from a standby attorney.

Hostetter used his closing arguments to spin conspiracy theories about the Jan. 6, 2021, riot. He falsely claimed the 2020 election was stolen from former President Donald Trump, portrayed himself as a victim of FBI corruption and referred to the mob’s attack as a “federal setup” involving “crisis actors wearing costumes.” He downplayed violence at the Capitol, referring to the riot as “basically the equivalent of a three-hour hissy fit.”

Hostetter — who previously served as police chief in La Habra, California, near Los Angeles — was convicted on all four counts, including conspiracy to obstruct an official proceeding and entering a restricted area with a deadly or dangerous weapon. The judge scheduled sentencing for Oct. 13, and denied a Justice Department request to have Hostetter jailed immediately.

Federal prosecutors said Hostetter has no evidence to support his conspiracy theories but stressed that he was charged with crimes for his actions on Jan. 6 — not his political beliefs. One prosecutor, Jason Manning, said Hostetter advocated for violence and mobilized allies to join him in Washington on Jan. 6 because he “didn’t like the election results.”

 

One thing that strikes me (beyond the idea that these guys consider themselves patriots when they're the opposite) is that they consider themselves tough guys who immediately turned into such weenies. Rather than stand up and say "Damn, right, we were trying to overturn the election. And we'd do it again!" they blame the feds, crisis actors in costume, they were set up ... Anything but man up.

The Justice Department’s announcement came after it suffered a rare setback in a related case involving Oath Keepers associates. A former “Jesus Christ Superstar” actor was acquitted Wednesday of conspiring with members of the far-right extremist group to obstruct Congress in the Capitol attack.

James Beeks — a Florida resident who was playing Judas in the traveling production of the musical when he was arrested — was cleared of conspiracy to obstruct Congress’ certification of the 2020 election and civil disorder after a trial in federal court. U.S. District Judge Amit Mehta convicted Beeks’ co-defendant, Ohio resident Donovan Crowl, of the same charges after hearing evidence without a jury.

Beeks is only the second Jan. 6 defendant to be acquitted of all charges after a trial.

I imagine the likelihood of a prosecutor successfully appealing the sentence from a Federal judge is pretty low, even if the sentence is below the guidelines?

An Arkansas truck driver who beat a police officer with a flagpole attached to an American flag during the U.S. Capitol riot was sentenced Monday to more than four years in prison.

Peter Francis Stager struck the Metropolitan Police Department officer with his flagpole at least three times as other rioters pulled the officer, head first, into the crowd outside the Capitol on Jan. 6, 2021. The bruised officer was among more than 100 police officers injured during the riot.

Stager also stood over and screamed profanities at another officer, who was seriously injured when several other rioters dragged him into the mob and beat him, according to federal prosecutors.

After the beatings, Stager was captured on video saying, “Every single one of those Capitol law enforcement officers, death is the remedy. That is the only remedy they get.”

Secret Service agents were in close communication with Oath Keepers leader Stewart Rhodes months before the Jan. 6 insurrection he helped plan.

The government watchdog Citizens for Responsibility and Ethics in Washington (CREW) obtained internal Secret Service emails showing an agent sent an email to others within the agency in September 2020 notifying them he had spoke to Rhodes about an upcoming visit by then-president Donald Trump to Fayetteville, North Carolina.

The agent described himself "the unofficial liaison to the Oath Keepers (inching towards official)" in the email, and said Rhodes and other members of the anti-government militia wanted "to provide protection and medical attention to Trump supporters if they come under attack by leftist groups.”

He told the other agents that Rhodes "had specific questions" and shared the Oath Keepers founder's cell phone number, and the agent followed up the following day with another email explaining the group members hoped to "assist those attending the event make it to and from their cars safely. They are NOT there to demonstrate or push a political agenda.”
