The person the plaintiff claims submitted a request for a "same-sex" marriage website is married to a woman, has kids, and says he did not submit the request. After this session it is clear that this court is not normal. They are blatantly overturning settled law. It is an activist court legislating from the bench. Biden will need to pack the court if the elections go the right way next year because there is now nothing to lose - the GOP has politicized the courts and it is irreversible. Buckle up if he has the courage.
Biden is not the guy that's going to pack the court, I'm not sure who that person is on the D bench, but its definitely not an 80 year old institutionalist that was in the Senate longer than many people have been alive. This is a big problem with the geriatric leadership in the party. They dont see the writing on the wall and think its still 1996, and if they do, they dont have the stomach to do it because they are too comfortable. They basically just hope things work out, and that the Roberts court controls itself from the wildest type of insanity. As long as voters can be convinced the Republicans are worse, they can basically get away with doing very little other than being a slightly saner alternative.
True, but today's ruling call yesterday's sentiments into question, even though I knew they were coming, at least on 303. I wasn't sure on student that. They are heavily into their major questions issue jurisprudence, which makes no sense. I can't come up with a better metaphor than I did before, which is to say that it's like saying that a home run has to go at least to the upper deck if it's at an important part of the game to count as a home run. It makes no sense. Regardless of what one thinks of the wisdom of the overall policy, the statutory authorization was pretty clear. The USSC just said it wasn't clear enough for a so-called major issue. At least that's what the briefing was about. Maybe the decision framed it differently. But it's such a nonsense wholly invented legal principle. And in any event, it's another really example of the Court making national policy without deference to the elected branches.
For me, this was a good session. I agreed with a lot of what they did (for reasons largely outside the strict law view) but it will anger democrats and therefore make trump even less likely to win next fall. So thumbs up.

It would never be presented that way. It will be wordsmithed into protecting Trump, no one else. Thomas is the likely man for the job, although Alito is a super eager worker bee also.
I have a feeling that they'll remand back to the trial court. If Gorsuch was assigned to write the Opinion in order to take some heat off of Alito and Thomas, I can only hope some Native American tribes filed amicus briefs in opposition to Trump's arguments.
