    Said it before, in households with young children guns should be stored securely, unloaded and separated from ammunition. When people with young children are so paranoid that they feel a need to have a readily accessible loaded firearm tragedies like the one in the subject of this thread are almost a certainty.

    It was in illegal weapon. But yeah talk about adding insult to injury. Bad enough he shot himself like a dumbass but gets arrested for it too.

    The illegal weapon charge I get but how does the state know wether the gun malfunctioned or not? I think that needs to be determined before such a charge can be added.

    Im guessing he probably told the police what happened when they arrived at his home. Had he claimed it malfunctioned he might have gotten out of the reckless discharge charge.

    Or it could be as simple as it is impossible to not recklessly discharge a weapon that you possess illegally. If it goes off for any reason while in your possession illegally you get hit with the reckless discharge too.

    That may be it.

    Similar to Florida’s felony murder rule where someone dies during a felony and the felon is charged with murder.

    This report has a bad smell to it. Must have been a damn large and mature two year old to hold and aim even a small 9MM.

    There’s just a lot of strange things that would have to fall perfectly in place for a two year old to have done this.

    Let’s wait for the facts.

    Toddler shoot adults quite frequently. “You’ve heard of the term natural born killer”? Could be an accident or he could be a bad seed.

    Either way best to ban guns they’re not even safe among toddlers.

    I represented a young man who, along with a couple of friends, were trying to rob a couple of out of towners in Ybor City. Plain clothes TPD officers happened to come up on it and an officer shot and killed one of the robbers. Under our felony murder rule statute, the surviving robbers were properly charged with the third degree murder of their dead accomplice. That result took some explaining to the family.

    Do you like the felony murder rule as written in Florida.

    Another circumstance would be a firefighter dying fighting a fire that was set (arson) or a person being robbed pulls out a gun, shoots at the robber, misses, and kills a bystander. Felony murder charge for the robber even though the person being robbed shot the gun. Is that right iyo?

    I recall a really bizarre case that occurred decades ago. A man attempted to rob a bank using an unloaded pistol. An elderly security guard fired at the robber missing the robber and with his shot hitting and killing a bystander. The robber was charged with murder under the felony murder rule. The case was ultimately resolved through a plea bargain with defendant pleading guilty to involuntary manslaughter.
