    I am personally unfamiliar with the rules of criminal procedure. However, I read someone fairly persuasively, say that venue, as most naturally laid in the Southern District of Florida as the situs of the crime. There is an argument with the crime was failing to return documents in DC. However, if the case was filed in DC, it would’ve been subject to numerous venue challenges which could’ve delayed a year. Marcy Wheeler has said that she still expects other charges to be filed in DC based upon her reading of the record, and she is usually pretty smart about such matters.

    Under the Espionage Act, they only need be “related to national defense.”

    Equal application of the law talking point nonsense is strengthening Trump and marginalizing the field through martyrdom . Curious if some will break (other than Christie) or they stay the course. Seems to be Trump is guilty, but so was errbody, so he is still my boy!

    lot of assets were killed. so many that the CIA issued a memo to their staff about it.

    I wonder if some spook that lost someone close to him/her isn't going to target DT after reading the indictments. DOJ may be the least of his worries. Not wanting it to happen but it wouldn't be out of the realm of possibility and if someone really wants you dead it can usually be done if you are willing to suffer the consequences.

    Leading counterintelligence officials issued a memo to all of the CIA’s global stations saying that a concerning number of U.S. informants were being captured and executed.

    The CIA’s counterintelligence mission center investigated dozens of incidents in the last few years that involved killings, arrests or compromises of foreign informants. In an unusual move, the message sent via a top secret cable included the specific number of agents killed by other intelligence agencies, according to The New York Times.

    Officials said that level of detail is a sign of the significance of the cable. Announcing the specific number of killings is rare as that figure is typically held under wraps from the public and even from some CIA employees, the Times noted.

    The cable, which also cited the issue of putting “mission over security,” comes amid recent efforts by countries like Russia, China, Iran and Pakistan to find CIA informants and turn them into double agents, the Times reported.

    You don't understand that law, either, if you are suggesting HC clearly violated it. That, at least, is understandable. Once we get a few more normal people elected to Congress, it needs to be rewritten.

    Is an unprinted email that is just being digitally stored someplace one of these:

    "Whoever, lawfully having possession of, access to, control over, or being entrusted with any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, or note relating to the national defense, or information relating to the national defense which information the possessor has reason to believe could be used to the injury of the United States or to the advantage of any foreign nation, willfully communicates, delivers, transmits or causes to be communicated, delivered, or transmitted … to any person not entitled to receive it, or willfully retains the same and fails to deliver it on demand to the officer or employee of the United States entitled to receive it …"

    The parts of him taking boxes with him when traveling between residences is also bizarre.
    I would think the obstruction had to be charged in Miami. Will see how many nutty protesters head down there. Florida concealed carry oh my.
    Last time mass protests went to Miami didn’t work out so well, G20 pnw nuts.

    Stop voting in members of the freedom caucus. Stop voting for people associated with Turning Point. You voted these extremists in. Now, YOU get them out. You sold your souls and now you are trying to play this reset game. Biden is a poor candidate. But he is moderate. Start by voting in moderates. Your woke war is going to get crushed in 2024 and I think you are starting to realize it. The GOP is a complete mess right now.

    I look at these doc cases like speeding. They all do it. Go 5 over, pfft, 10 over and getting looks, 15 over and paper is getting handed out, 30 over, going to jail. Meanwhile, Trump going 60 over, saying, bbbbut, look at that tortoise.

    Wrong. And "clearly violating the law" is not the standard for an indictment, Mr. Lawyer.

    Fair enough. But that's a mere opinion on policy.

    I would say either a "writing" or a "note" (EDIT: or "information") "relating to national defense."

    Not sure if the statute clarifies a different definition for "writing" but under the FRE, a writing is: letters, words, numbers, or their equivalent set down in any form.

    The degrees in which everybody was going over is strictly speculation and opinion to the point that the analogy gets lost.

    It's not like we have a unit conversion, chemistry class style, between speeding and Espionage Act violations.

    Only it is not speculation. The FBI twice looked at Hillary's emails. Pence was just cleared by the DOJ. Trump? Read the indictment. Had Hillary or Pence come close to anything like Trump did, they would have been charged too.
