    At least one of the recordings was an interview he was doing with a reporter. So not clandestine stuff here. Thats how dumb Trump is.

    I am not sure it was giving him the benefit of the doubt as much as suggesting that selling national secrets didn’t really seem consistent with Trump’s history. Now anything is possible, as the serial killer next scenario shows, but having the documents to show how smart or special he is just seems so much more Trump.

    He was being interviewed so it was likely consensual. The writer asks for permission so he can accurately quote. And federal law— which applies here— allows recordings in one party consent anyway

    In many states it is legal to record conversations without the other person's knowledge. Here in NC, as long as one of the two in the conversation knows the recording is happening, it is legal. So as long as the person recording is present they can record. But a third person can't hide a recorder and record conversations when they aren't present.

    Seems like Cohen and maybe other of his lawyers have recorded him too. I didn’t really think about the distinction under Federal law.

    In Florida it is illegal to record conversations unless all parties have agreed. there are exceptions like speaking in a public space

    How is it in anyway “inconsistent” with his history. He’s 100% transactional. If he thinks he has something of values he’s going to sell it or trade on it. He’s 100% shady and nothing I’ve seen suggests he wouldn’t, especially to “Daddy Big Bucks Bonesaws”. I’ll stipulate he’s one of the dumbest people walking around but that’s not to say he’s too stupid to have that intent.

    I don’t have the indictment open, but my recollection is that at least one of the recorded conversations occurred at Bedminster Club in NJ.

    But, in any event, there shouldn’t be recording consent issues here. This isn’t a case of surreptitious recording. Again, like all things Trump, it’s much, much dumber than that. These are meetings that occurred for the sole purpose of Trump letting people record him - taped interviews with authors.

    Trump’s just the guy who can’t process that, when being recorded by someone who probably doesn’t like him in the first place, it’s not a good idea to - on tape - say “I’m probably not supposed to have this, and I’m definitely not supposed to show you, but come look at this. Isn’t that cool?”

    Cute, although a factually inaccurate and a rather feeble attempt at humor considering that Hunter is still under investigation by the DOJ and by the way the DOJ official responsible for investigating Hunter is the US Attorney for Delaware, a holdover from the Trump Administration.

    18 U.S.C. § 2511(2)(d) requires only that one party give consent.

    Florida's law is especially harsh. If the recording violates the statute, it is a generally a felony to record it, generally a felony to play it for another person and the recording is inadmissible in any proceeding except for the prosecution of the individual who recorded it it or disseminated it or a civil lawsuit based on a violation.

    I don’t know why the Biden White House isn’t pouncing on this with both feet. They need to pound the fact that It’s the Democrats who are the law and order Party, that the law is king and not Trump, and that the same laws that can land a poor black person in prison can also put a rich and powerful white person in the same place.
