    DeSantis is a panderer. I haven't heard about this until you posted it. I'd think DeSantis would reason he could benefit by supporting a minority military vet. Just guessing. Either way I think his involvement In the subway case in another state is shameless pandering.

    ehhh. I think you’re being overboard. Did the guy commit manslaughter? Undoubtedly. But I don’t think he intended to kill the guy, only subdue him. Other train passengers felt threatened. I have some sympathy here. He’s not garbage like Desantis is IMO.

    There's no need to guess. People have been fighting for Giles for years. DeSantis became governor in January 2019. If he wanted to do something about it, he would have.

    Initially, yes, but you don't keep someone in a choke hold for 15 minutes. That is using deadly force.

    It sounds like manslaughter, to me. And I don't know how a trained Marine could be unaware of the consequences of a choke hold.

    I’d say just because the guy did this, doesn’t mean “he’s garbage”. Who amongst us hasn’t wanted to choke out some annoying hobo on a bus or train, or just off that guy that tries to have 13 items in the Pubiix Express lane when it clearly says 10 items or less? I mean come on, there’s so many stupid idiots out there, and some of those hobos reek of b.o. and urine. It’s like a constant urge to kill that must be suppressed at all times. Some of us might slip up once in awhile, but that doesn’t make us garbage, it just makes us human.

    At this point, we still don’t know the exact sequence of events between this guy acting out and the marine putting him in a choke hold. It seems like the marine probably overreacted, and at some level he should be held accountable for that, but we still don’t know exactly what happened. It may be comforting to assume the marine is a malicious racist killer, but until the evidence points to that I’m going to keep an open mind.

    If I’m the marine I’d tell Desantis thanks, but I don’t need your help.

    I was just joking around with that post, but i actually agree.

    I haven’t seen any evidence he’s “garbage” or that this was a pattern of behavior. It wouldn’t be surprising either way (look at the trash that was revealed about that Jack Teixera fellow). But in this guys case, haven’t seen that… yet.

    I do think a manslaughter charge is appropriate though. If this was an airline and a passenger was acting crazy maybe you could justify subduing like that for an extended period. On a subway? Sorry, you can just move to the next car or get off at the next stop. Other passengers managed to not kill the guy. Perry’s issue is he wasn’t actually being threatened, in fact he choked the guy from behind, kind of impossible to claim “self defense” when you sneak up behind a guy and initiate a chokehold imo. Even if the guy was having a public mental freak out, that isn’t the standard giving some Joe Vigilante the right to step in and chokehold him.

    I guarantee most people on here are defending the Neely only because of his race. Because apparently nowadays non white people do no wrong.

    He acted a fool and got what he deserved.

    He was apparently mentally ill and likely should have been institutionalized. You think Joe Vigilante should be free to go around doling out death sentences to the mentally ill?

    I get it’s frustrating to see homeless on the street and some may be dangerously ill. That doesn’t give you the right to kill them. There needs to be legit self defense situation to justify that. It just doesn’t sound like the case here.

    And saying that he didn’t deserve to die for acting out is “defending” him, as if he had whistled at a white woman.

    I have no opinion on this case. Will let the justice system determine if the accused acted reasonably or not. But a good samaritan would have helped the deceased, not put him on a chokehold.

    DeSantis is another right wing fake Christian who has probably never read the Bible, much less understand its teachings.

    It's doing violence to the parable, but no more so than what that movement does with the Nazorean's teachings on the rich. But this perversion really hit home with me because it is our current Holy Father's favorite parable and the one he uses most commonly as the theme for his teaching.

    LOL, I guess you've never been to first presentation/preliminary presentation court. Gator_ lawyer is expressing an opinion based on the current available facts. At this time it is the legally correct one, at least as to manslaughter. If the facts change or additional facts come to light, I'm sure that opinion is subject to change.

    Since you obviously didn't understand the reference...at PP court judges make a determination as to whether or not probable cause exists to hold an arrested person for a crime based on a 20 second review of a 1 or 2 paragraph probable cause affidavit. Decisions as to whether to raise or lower bonds are frequently made in that same review. You were criticizing Gator_lawyer for something attorneys deal with on a daily basis. There is far more information available about this subway homicide than our PP court judges usually have..

    Publicly executed on video but you probably never heard about it

    Then, on the night of Feb. 27, she got the call that he was dead.

    In the video, Saldana can be seen sitting on the curb as the shooter stands near him, talking on a phone and struggling to load a gun right before he shoots Saldana. Police said the two had been arguing across the street before the video began.

    The shooter fires once, and the person recording the video shouts, “He just (expletive) killed him!”

    “I don’t think my son could tell just how dangerous this man was in St. Louis,” Aurea said. “I guarantee you he had no idea the type of danger he was in even conversing with this person.”

    Politically, you’re probably correct. Financially, probably not. Especially now that this case has been politicized into another stupid game of us-and-them, the cost of his legal defense is going to be very high. You’ve seen laughably ignorant posts on this thread alone, such as “he was being choked out for 15 minutes” or “based on the position of the hold, the accused definitely attacked the deceased from behind.” He’s going to need expert witnesses that speak to his MCMAP training; how it is clear even in the selective video edits we’ve seen he’s not applying the choke continuously, only when the victim is trying to escape; how a trained Marine can easily achieve the position in question even when engaging from the front. He’s going to need to prove (though, theoretically the accused shouldn’t have to prove anything) that racial bias played no role in his decision to intervene in whatever happened. And that’s going to be more money expertly scrubbing his history. He’s going to need expert witnesses to sift through the deceased’s entire medical history for evidence that pre-existing conditions or drug use may have contribute to his death, even if the accused did not apply the choke continuously. And who knows what else. That’s going to be a small fortune that most people can’t just cough up without a lot of help.

    Before you call those posts "laughably ignorant," be aware there are witness reports to that effect. The time he used that force isn't critical, it's the fact he was only unathorized to use non-deadly force in that situation. In this video you even hear a passenger yelling to Penny "You're gonna kill him now." Even that passenger recognized what was happening. He killed an unarmed man that was not threatening great bodily harm. Lethal force is not authorized in that situation and, before you use force that can cause death, you better be damn sure you know what you are doing and don't use that level of force long enough to kill someone...or you get charged with manslaughter.
