The DA addressed that n his press conference. It's not in the indictment because NY law doesn't require it to be. Every count states "in violation of penal law Section 175.10", it doesn't have to allege the crime the falsified record was trying to cover up.
I'm kind of surprised, I was expecting more of his tax evasion stuff to be thrown in too when the number of counts grew to 30+.

After the DA’s PC, the CNN lawyers weren’t exactly impressed with the charges or rationale. If you can’t win over the CNN guys, the jury might be a tough sell. Still have to see the evidence though, and I do believe the misdemeanor case is solid, if they are within the SOL. My guess is that he gets convicted with the lower charges, everyone wins and everyone loses, and we fight about Trump all the way til Election Day again. Which is why the Georgia case matters so much. The other cases too, but that is the one that could impact things before the election most likely.

An NDA isn’t a payoff. It is a binding legal agreement. There is nothing wrong with the NDA. NY has to prove the accounting was done in the manner it was in order to cover another crime.
How do you, or any other Trump apologists here, feel about the Michael Cohen conviction, for essentially the same thing and the same incident, prosecuted by the US attorney during the Trump administration?
