Question, seems that the misdemeanor charges are far more solid than the felonies. Do we know if the SOL has actually passed on the misdemeanor level? Heard something that between Trump leaving the state and a delay put up by Cuomo on the SOL timelines making it murky? And can the jury go with a misdemeanor if they don’t see the mitigating factor?
So what’s the consensus? Is this really a felony case? ABC News is less than impressed. They say nothing new and asking why is it just coming out now.

A jury can always convict of the lesser included offenses they are provided with to chose from In Florida (guessing NY is similar) the lawyers and judge have a charge conference after the close of evidence, but prior to final arguments. The Florida Supreme Court has promulgated standard jury instructions. Some general ones are read in every case, some are crime specific. There are some lesser include offenses that are read every time a particular crime is charged, others depend on the facts. Each party presents their proposed jury instructions and the judge ultimately decides which ones are read. Discretion is generally exercised in favor of the defendant. The SOL issue will be hotly litigated. It will come down to what "continuously absent from the state of New York" means. I think they are solid on the felonies. At the press conference the DA indicated these falsified records were not only to help his presidential bid, but also to avoid paying taxes, including NY taxes. The later, in particular, is going to be hard to argue against.
Wow even CNN calling this indictment “underwhelming” I’m far from a lawyer but shouldn’t an indictment actually state which law was broken?
