It's a logical way to do it. Nudity has been defined in Florida statutes for years, there is an abundance of case law interpreting it and upholding the state's power to regulate it, both by statute/ordinance and through establishments' liquor licenses. The same is true for sexual conduct. You don't need to reinvent the wheel just because the entertainment is dressed differently.

That was litigated in federal court in Tampa years ago..."Dave the Dwarf," who was tied into one of the local radio stations, was involved.

Sorry. I wasnt trying to be smug. I mean why is one persons line any better than another? And if thats the case, why is the more liberal line the one that is correct?

Assuming there's no nudity and no real or simulated sexual activity, where else do you want to draw a line that isn't constitutionally protected activity such as the adult language version of "Rudolf, the Red Nosed Reindeer" that got into the OP complaint? (I can just see the judge rolling his or hers eyes when reading that section of the Complaint.)

My line is easy to understand and doesn't broadly infringe on artistic expression.

When it comes to nosing in to how other people are raising their kids, the "line" needs to have near-universal acceptance.

If kids are by themselves, that's a different story. But when they're with their parents, the government should have little to no say in the matter.

This is the correct answer. What ever happened to personal responsibility?

It’s almost as if the GOP was completely full of shit when I was growing up about being proponents of small government and “family values.”

I think simulated sexual activity is what was at question in this case right? (I agree fwiw)

    Who is arguing that?

But without information how do they do that? All I am proposing is legislation that requires informing the parents of adult content. I am not proposing we take any decision from parents.

You keep asking where the line should be and why. That’s the answer.

You weren’t advocating upthread to make pantomiming masturbation in front a child a misdemeanor?

Why are you unable to screen content yourself?

I think much like the movie industry... self policing is probably best. Comedy shows dont have a rating they just restrict ages voluntarily.

The real issue is that no one has shown a single clip of indecency from the "drag Christmas". I put a video up thread and i dont think it required age restriction. Do you?

Charlotte has drag shows... some are brunch entertainment which dont show age restrictions

    Some are +21.

I mean is this really a problem? Are there inappropriate shows geared at kids?

Ok. But a parent should have all the info for stuff before showing up. Any entertainment should have certain disclaimers just as the MLB example I cited. That is literally all I am saying.

I have no disagreement that parents should screen content, but that’s my job, not the government’s.

Good points made in this discussion. But I wonder ….. did the parents that took their kids to see the at issue drag queen show care there were fake female genitalia and acts of self gratification by the performers? I doubt they cared.
