Well, we knew this was coming. The lawyer for Proud Boy Dominic Pezzola was apparently stupid enough to drink the Tucker Carlson Jan 6 Kool-Aid and filed a motion to dismiss claiming a Brady violation by the DOJ based on the Carlson videos. A Brady violation occurs when the prosecuting authority intentionally withholds exculpatory material from the defense.

Understandably, our DOJ was not pleased with the accusation. It seems that despite Carlson's "bombshell" reporting, ALL of the video footage was made available to the defendants, including Tucker's highly selectively edited video footage. 10 seconds was initially withheld as it apparently showed an escape corridor, but even that was subsequently released. DOJ also argues none of the Carlson videos are exculpatory as they do not show actions during the relevant time, rather the bulk of it seems to be after the melee as police are taking back control of the Capital and order is being restored.

After the district judge gets through with him, we'll have another attorney ruing the day he ever heard the names Tucker Carlson and Fox "News" as he will likely get sanctioned.

I get how Marjorie Taylor Greene, who is laughably demanding new trials based on this "bombshell evidence," and the typical Fox "News" viewer might have bitten on Tucker's shennigans, but this guy completed 7 years of college and should know better.

(Ignore the editorial content if you want and just listen to the pleading being read....priceless.)

Trump literally had a “6 step plan” in writing, from his lawyer Eastman on how to retain power, and it centered around stopping Pense from declaring Biden the winner … which you know…. Was what that congressional meeting was for…

Insurrectionists: “We’re going to take over the government!”

Police: “Alright boys, you’ve had your fun. Time to go home.”

    Insurrectionists: “Oh, okay.”

I may not agree with virtually anything you post bit I know you're capable of thinking this through. Would you have the police start hog tying people when they're outnumbered 10:1? Would that have helped the situation? Or was it better to try to de-escalate, get people out of the building, and then arrest them later?

    1. Did anyone say that they had a chance to be successful?
    2. Does it make any difference that they had no chance of overthrowing the government?

Based on her ruling one can infer that Fox's business model is based on appealing to viewers who are either incapable of reasoning or those who elect to remain willfully ignorant and it has been a very successful model.

We don’t know what would have happened if they had overrun the police lines faster and gotten into Congress or had captured Pence. And, as the videos show, they were close to the latter. If Pence’s wasn’t available for his Constitutional duty, the capitol was occupied through January 6, the election was not certitudes and Trump declared Marshall law January 7, then what?

Well, I guess all should be thankful the Capital police did the job they did …. and that many if not most of the Jan6th protesters did not engage in riotous and destructive criminal behavior, especially inside of the Capital.

Has Trump ever held himself responsible for anything that wasn’t positive… or a win for him?

Of course not. He's a selfish prick and a terrible leader. I wonder who in their right mind would vote for such a garbage individual like this to be president?
