Yes. With good reason. I hope they get soaked. However, knowingly telling falsehoods should not be criminal. Need to protect the free press and whatever Fox is. And certainly not treason. Going at it civilly is the way to go in this layman’s view.
It could be criminal. I’m sure it won’t be, but it’s not like there is a huge leap. I mean… basically it’s conspiracy to commit fraud laid out in various email chains. Although there is generally lots of leeway given to marketers and commercial actors to lie, a bit too much leeway if you ask me. The other issue who is the victim? Dominion is victim of defamation, but they were not defrauded by Fox. Who is identified as victim then? You could say the advertisers, but it’s really the public writ large. Treason is obviously a stretch. It’s more of the colloquial definition of treason rather than meeting the legal standard.

I’m without a team. And I no longer have to have an opinion about whether Fox knowingly pushes a false narrative, their own words confirm they push the false narrative. It’s fact.
Yeah, I’m not a lawyer, so I’m sure there are things I don’t understand. But common sense me says, when you know you’re screwed, take you medicine and get on with your life. Don’t make it worse. I was thinking they should have settled. But maybe Fox said no, or whatever settlement talk there was had dominion asking for crazy numbers, and they had no choice. But they had to know what dominion would find in discovery, and barring a miracle, once they did it was game over.
Each side has a different agenda. Settlements may not be about money. I would imagine Dominion wants to protect, and bolster, its brand. Fox has the same agenda, so marrying those diametrically opposed goals make’s resolution difficult. While Dominion did a great job showing how untrustworthy Fox truly was, that does not necessarily mean that they will win the liability case for defamation, which is a difficult case to win. And, to be fair and from what I’ve read, Fox has done an excellent job of mitigating the exposure to damages. They’ve shown Dominion’s valuation to be hyper-inflated and their “losses” thus far to have been exaggerated. But I’m not sure the damages component matters when the goal is brand-repair.
