    Might that be the part of the New York Times vs. Sullivan decision that referenced “reckless disregard for the truth?”

    Still remember that from my Communications Law class at UF.

    Have to wonder if Fox will use the Tucker Carlson defense again.

    The depositions should really be interesting since what Sean and Tucker and the other Fox purveyors of fake news have been said regarding Dominion has virtually no basis in fact. Although it's a really weak rationalization my guess is that they will say that they were simply repeating the opinions of others who were supposedly more knowledgeable on the subject.

    I think that falls safely in the category of "Reckless disregard for the truth" though it would be fun to hear them admit than anyone knows more than they do.

    And so it goes that Fox prime time personalities knew what they were broadcasting about Dominion were LIES. Did it anyway.

    Fox News hosts called 2020 election fraud 'total BS' in private, new Dominion court filing says

    Fox News anchors and producers privately acknowledged that former President Donald Trump and his allies' allegations of election fraud in the aftermath of the 2020 election were false despite their network's promotion of those claims, according to a new court filing by Dominion Voting Systems.

    In mid-November 2020, host Tucker Carlson texted one of his producers that "there wasn't enough fraud to change the outcome" of the election, and later said that Sidney Powell, one of Trump's attorneys and a vocal promulgator of election denialism, "is lying."

    Months later, on Jan. 6, Carlson called Trump "a demonic force, a destroyer," in a text message to the same producer. Dana Perino, an anchor, called allegations of voter fraud against Dominion "total bs," "insane," and "nonsense."

    They knew that the things they were saying about the election every night were false but did it anyway. Is that just free speech or does a broadcaster bear responsibilities for how they use the public’s airwaves?

    And now there is uncontroverted crystal clear proof that the Foxian Idols, including Tucker, knew without a shadow of a doubt that they were lying to America in pushing the election scam.

    The most telling of the communications is how Tucker forced the network to stop their fact checker from doing her job. He said she was hurting “the stock price.” Truly unbelievable, indeed inconceivable.

    They have now demonstrated beyond a shadow of a doubt that they lack an ounce of credibility.

    Anyone that treats these propagandists as anything other than laughable entertainment, is willfully, ignorantly, shamelessly blind to reality.

    Lol, that post was sarcasm.
    It was crazy dumb to give someone that kind of access when you know you were BSing the story and dominion did nothing wrong. But maybe they were hoping for a miracle and figured they were already screwed.

    It's also clear that Fox knew that when it declared Arizona for Biden, even though it was accurate, it sent a lot of viewers running to Newsmax.
    Maybe they figured if they perpetuated the fraud myth, kept bringing on Powell, Giuliani, etc., they could win them back.
    It's also worth noting that not only did they know the fraud claims were bogus, but they also realized they were actually dangerous. If half the country is convinced our elections are a fraud, how do we maintain a democracy?

    Of course they're not stupid but they're also smart enough to realize that promulgating falsehoods is great for ratings when their target audience consists primarily of uncritical easily influenced viewers already predisposed to believing those falsehoods.
    Fox News won a court case by 'persuasively' arguing that no 'reasonable viewer' takes Tucker Carlson seriously
    While no "reasonable viewer" may take Tucker Carlson or implicitly its other infotainment stars seriously Fox News has done very well banking on data indicating there are more than enough viewers who have apparently lost or may have never had the ability to think reasonably.
