This probably deserves its own thread, but the federal judge (Hinkle) in the Andrew Warren case ruled that DeSantis violated both the federal and state constitution in removing Warren from office, but that he (Hinkle) doesn’t have the authority to reinstate Warren per the 11th amendment to the U.S. Constitution. In a nutshell, Hinkle seems to be ruling that this is a state matter, so it is up to the state courts to determine whether Warren or any other state official removed by a governor for no good reason is entitled to be reinstated. DeSantis’s office has called this a great victory despite the determination that DeSantis violated both the federal and state constitutions.

Funny how your preferred media source frames that. Here's what's really happening: The presidents are calling DeSantis's bluff. They have chosen their words very carefully. Very little, if anything, will change at the colleges. DeSantis will lose his battle against academic freedom in higher education, but will still claim victory.

The presidents of Florida’s 28 state and community colleges said in a statement on Wednesday that they would identify and eliminate, by February 1, any academic requirement or program “that compels belief in critical race theory or related concepts such as intersectionality.”

Note the use of the words "compels belief in." Again, they are simply calling his bluff.

The judge said DeSantis also violated Warren’s rights by considering his “alleged association with Mr. [George] Soros.”

“The Governor violated the First Amendment by considering Mr. Warren’s association with the Democratic Party and alleged association with Mr. Soros as motivating factors in the decision,” he said.

Hinkle said the suspension violated the Florida Constitution.

 

I'm not surprised that DeSantis considers it a great victory. He has to be stoked that he's set a precedent that he can violate the Constitution and get away with it.

 

His title is definitely clickbait.

disappointing how Fox News has dropped over the last few years in reliability. Fox always had a conservative bias, but now it’s less based in fact.

He's basically punting. Reinstating Warren would mean removing the crony DeSantis put in his place. The federal judge doesn't want to do that, so he's basically telling Warren he needs to go to the Florida state courts.

 

Is reinstatement the only remedy? His opinion seemed very clear. Is that strong of an opinion usually offered with rulings or am I the only one surprised at his statements?

 

This isn't the first time Judge Hinkle has done something like this. When he sees something wrong but doesn't feel it's his place to intervene (for whatever reason), he'll issue a strong opinion and then punt on the relief. But no, that strong of an opinion isn't a normal thing.
