The docs were found when Biden had staff clean out his old office at Penn. Probably because the office was no longer in use, and maybe Penn wants the space back? Just speculation. Regardless, the fact that docs were found prompted a search of other locations.

I can buy Biden didn't know he had them. Things get lost in boxes when you move. Just as I can believe Trump didn't know every classified document he had when he moved from the WH to MAR. And again, had Trump cooperated with the National Archives and returned 100% of the docs by April, 2021, this is a non-story. Trump could have used the explanation that some things were inadvertently packed and labeled Trump personal materials that actually belonged to the NA and ended up in MAR by mistake. Even if this was a lie, had all the docs been returned without any hassle, the public would have bought it. But since Trump refused to cooperate at first, and then lied about returning all the material later on, and refused to cooperate again, the story is much different.

 

First and foremost President Biden knew they were taken when he left the VP office. The VP office should have been cleaned out of all classified documents as well as the VP residence when former VP Biden's tenure was up. Every bit of that should have been in secured office space under lock and key ready for transport to a secure location or SCIF.
I'm not buying the addle brained of gee I didn't know excuse.

We also have to take into consideration VP Biden went to his Delaware residence during his tenure on a regular basis. To claim I didn't know is beyond belief especially when you are the second in command dealing with classified information on a daily basis.

Spin all you want there is no acceptable excuse for this.

No excuse. It shouldn't happen. But it does happen. And probably more than we would like to know. Here's a list of all open Unauthorized Disposition of Federal Records cases that have have been opened since Oct, 2016.

I agree it does happen but it doesn't happen without forethought and review of material to decide what they want to keep. Movers are not going to go through any boxes that you personally pack for transport. They mark the box as packed by owner and throw it on the truck.

Of course this doesn't mean that the documents were moved by a packing crew. As I stated before former VP Biden could have and most likely did take those documents with him on various trips to the Delaware residence. The VP does travel with a secret service team but they are there to protect the VP and nothing else. Whatever the VP has in their possession at that time is never questioned or vetted.

So I've seen reporting that says that this stuff happened because there was a rush to move him out of the VP residence for Pence and it was complicated by foreign trips Biden had taken at the time. Not intentional packing like with Trump but fast yet lazy packing by Biden aides.

Regardless, no one goes to jail over stuff like this for confidential or top secret docs. Also, VIPs like Berger and others never go to jail period.

However, if there was really SCI stuff that belonged only in a SCIF in there like what Trump had laying about on his desk, then Biden really has some 'splainin to do.
