    Honestly are we over 20 documents yet? Trump intentionally took thousand of documents. Ignored efforts to get them back. Had lawyers obfuscate that he didn’t have them and then the fbi had to issue a search warrant to get them back.

    Biden took maybe 2 dozen documents. It isn’t right but can anybody see that there is a difference in scale and intention.

    We should all just wait until we know more, especially the level of classification and whet the docs were generally. Lots of just "C" marked docs that really are not that big a deal. We should wait to find out the facts

    Scale means nothing with classification. It could be a single sentence that could be very bad if it falls into the wrong hands.

    Yeah. Even when there's clear intent, I'm not sure what is typical in terms of sentencing. Patreous was providing classified information to his paramour and pled guilty. I don't recall how but he got it pled down to a misdemeanor and just got a fine and probation. Maybe part of that was because the classified information wasn't super classified or damaging? I don't know.

    Intent may matter in the court of public opinion (doubtful in our current polarized state), but isn’t taking official government records and putting them in your office or garage a strict liability kind of thing when it comes to possessing them, (unless they’ve been approved by the Archives as personal records)? That’s why it ultimately didn’t matter if Trump had declassified all the docs at MAL, because he didn’t have the right to possession in the first place.

    And honestly, we don’t know what Biden’s intent, if any, was in taking them, do we? We just know a raid wasn’t needed to get them back, and the numbers so far are far less than the last guy.

    Of these guys don’t commingle some docs on their way out, there are hundreds of thousands of pages over a 4 year term. But this just looks terrible for Biden, regardless of the numbers.

    Not going to say which is which but my guess in the end is that one special counsel will find deliberate misbehavior and aggravating factors with respect to the mishandling of classified documents which could support a recommendation for prosecution while the other special counsel will find negligence but no aggregating factors that would justify a recommendation for criminal prosecution.
    In the case of the classified documents, it’s more serious for Trump than Biden
