How would you tame NIL?

    This is a hot topic, after reading some of Dabo's comments on NIL and tampering, I think there can be steps made to calm the market some.

    1) Reintroduce the one year transfer sit out rule. Only those with family emergency/medical reason and grad transfers are immediately eligible. (Dabo echoed this and also stated that a player can earn an additional year of eligibility added back by graduating undergrad).

    This should quell some of the tampering going on because there's no longer an immediate benefit to do so. If a school wants to snipe a player from another roster, they have to wait for it.

    2) Hard cap on roster limits.

    3) Much like financial aid, a player who makes over a certain amount is no longer eligible for scholarship benefits. This in conjunction with the roster cap opens up the opportunity for other players to earn scholarships, while the mega-successful players are able to pay their own way from earnings.

    For sake of argument let's put it at an arbitrary figure, such as 50k/yr. A player who earns over that amount in NIL either has the option to pay their own way, or can still secure their scholarship by offsetting their income amount by putting any earnings over that figure into a retirement account to ensure their future or even into a trust that will pay out after their college career is over.

    That would hopefully help dampen the "fast money" mentality, while not restricting the players from actually getting money and set them up for the future.

    What else would you propose?

    Make it all transparent and out in the open. Right now it’s completely top-secret, no one really knows anything. Along with the roster post what each player is getting from NIL (wink-wink).

    No contact with any player on another team that has not entered the portal.

    That's already the rule but also the whole point of bringing the transfer sit out rule, to take away the incentive that teams/boosters currently have to skirt the existing rule.

    To me, besides having a hard line at the SEC Commissioner's office and having a threat for being removed from the league or heavy fines (ie, a luxury tax), this has to play out before there is a serious moment. This is new territory, and no one is going to just give up their new freedoms. It is going to take some VERY expensive lessons to change/make new rules.

    Think the NBA and the One-and-Done rule, better known as the "Kwame Brown" rule. Stupid is as stupid does.

    I would set up a trust for each player and whatever NIL money comes in goes to it. While a member of any college team, the player could only take out a maximum amount each month/year; an amount standardized across all college athletics. The player could gain access to whatever is left in the trust once he/she uses up his/her eligibility; can't play anymore due to injury/illness; moves on to a professional sport; formally declares he/she will no longer play the particular college sport. The "free agent" players might be deterred some from jumping around due to the max stipulation. The lower earning players would have to manage the money (like in the real world). Once they leave college, all controls would be off and he/she can blow the money as they see fit. Of course, I would make all of them do their own taxes just to show them what fun it is.

    #1 is the only feasible answer. Though I'd add the caveat that there should be no restrictions where a player can transfer by any entity.

    A few years ago when there was first talk about "paying" players I said once they opened this pandora's box it would be a problem they could never fix. The issue for me has always been that it's an issue that's probably related to maybe 10 players in all of college football each year that are the face of college football. The NCAA has used their likeness free of charge. That's wrong.

    These are the players who's faces you see on TV each week to market college football each week by the networks. I'm talking about guys like Johnny Manziel (sp?), Tim Tebow, Trevor Lawrence, Bryce Young, etc.. The players who people recognize by face. I absolutely agree that those small handful of players whose image is used to market college football should be compensated. But they should be compensated by the networks and people who use them.

    I also never had a problem with athletes making money for things they do that are not related to the sport of team they play for.

    I always had an issue with the idea of regular players getting paid because you had to know this disaster was the only possible outcome. As an advertising and marketing professional, I can tell you that 99%+ of all college football players and athletes have minimal to zero marketing value. I think you could pretty much say about the same about NFL players. Each team may have 3-4 players that have some value locally, but there are usually maybe 10 that have real marketing value on a national scale (Tom Brady, Aaron Rogers, Russell Wilson, Dak Prescott, Patrick Mahomes, TJ Watt, Josh Allen, Matthew Stafford (only since he won Super Bowl) ... and their endorsement money is a small fraction of their total salary.

    I have no problem with a college player being paid for actual work or for their "real" NIL value, but the idea that a kid gets paid $1 million+ right out of high school for doing nothing is a problem.

    I wouldn't even be opposed if a school or donor was able to pay for a multi-million dollar insurance policy for a player who has a career ending injury for staying in school. But what they have now is just wrong.

    I know it is, but it is being broken a lot more often now that NIL is in play. Again, no oversight from a pitiful NCAA.

    1) there would be a flood of lawsuits that the NCAA doesn't want to risk losing. Plus if a scholarship is a 1 yr contract, a player should absolutely have the right to seek out a new one every year.

    How about making all scholarships 2 yrs in length. Then you may be able to penalize a player that wants to transfer after the first year.

    2) there is a hard cap. 85 players on scholarship. 105 total (walk-ons)

    3) Doesn't fly. Players are given scholarships because of their athletic prowess not financial hardship. Tying their personal income to it would again bring on lawsuits. Probably from families that can afford to send their kid to college anyway.


    Everyone keeps forgetting, NIL is not coming from the universities. It comes from a 3rd party services contract. The university has no legal standing to restrict it. They can only challenge a contract if it is a direct violation or competition with the school brand. IE UF is a Jump Man school, can't have a player repping Addias.

    The only change I see coming will be stricter tampering rules. If tampering can be proven, harsh penalties need to be enforced. Not on a case by case basis, they must be uniform across all football. As in found guilty of tampering, you lose a set amount of scholarships and pay a set amount in fines.

    None of these things will happen. In our current societal climate the NCAA will not place any regulation that restricts a players’ potential.

    They will not cap how much they can make, they will not restrict their one-time movements, and they will likely drop academic standards once players are determined to be university employees and unionize.

    The NCAA will go extinct same way phonebooks did.

    Taking NIL money obligates you to play all games, including post-season games, unless you have bonafide injury. Failure to do so requires returning all NIL monies and cost of that year’s scholarship.

    This won't fly. NCAA has no legal right to impose this. The NIL money part would have to be negotiated between the player and 3rd party. No agent would agree to those terms.

    Make NIL truly that- right now its straight up payments

    Our low key NIL entity has worked with gator gymnasts as well as other collegiate athletes.
    The name and image use to market


    No one is going to cut scholarships will never happen.

    Look, in football maybe 20 kids gets decent money- the other 50-60 get breadcrumbs.


    Add value? Pay players for bowl games. Cut the worthless bowls. $10k

    Get disability policies for kids

    Get a $$ in sponsorships for 12 team playoff and divide by every player, provided each suits up.

    Nfl/NBA have rookie salary caps. Perhaps do that I know it would be hard, seems like there are guys getting 500k to play or more.

    It also seems like there are some guys just using it to get a big check and they move on the next year, I guess if some billionaire wants to throw his money away so be it.

    It will be interesting when they 17-18 year olds realize they have to pay taxes on that cash, Whats the bill for 500k a year? 100k or so with self employment tax i’d say.

    To institute a salary cap, you need to allow the players to unionize so the NCAA and players union can negotiate a collective bargaining agreement.

    Even then this CBA wouldn't effect NIL. Because NIL is 3 Rd party agreements
