DeSantis vs. Disney

    Florida has done nothing unconstitutional. It will be a fun fight to watch if Disney brings suit against Florida. My bet. They will not because Disney knows their Right to Free Speech was not violated.

    It’s worse because they understand the concept. But they’re hell-bent in supporting, protecting and stretching to excuse their demagogues’ actions.

    Yes. We would love to see that case, where every legal scholar has opined DeSantis would lose easily. But, DeSantis made a back-door deal with Disney that he’d give back what he unlawfully took from them in return for their silence.

    In other words, he successfully violated the Constitution’s guaranteed rights through bullying, governmental retaliation.

    Good luck with this one in Court. There is a reason Disney backed down instead of taking on DeSantis legally. The have backtracked to handle this behind closed doors. And it is honestly best for both sides to handle it this way.

    What a bizarre statement!!! An acknowledgment that you are neither a lawyer nor a constitutional law expert, while contemporaneously proclaiming you have a better understanding than someone who practices law for a living.

    That’s the type of hubristic admission that tells us all about the grounding of your arguments.

    You are not lining up to take Disney on as a client for their First Amendment Rights being violated? Well maybe you would to get your firms name out there as that can be a marketing strategy. Not one I would use but we both know Disney’s rights were not violated.

    Im also not trained in law, but interestingly I’m seeing this case as the opposite. In fact, I can’t recall a case that is so obviously a violation of 1A as this one. E.g. in the Masterpiece Cakeshop case, there was a clash of speech rights of two private entities, and it’s not obvious to me which should win out. Here, however, I can’t think of a single complicating aspect that would justify DeSantis doing this in retribution. If the case did go to court, I feel confident this would be DeSantis’ defense: “Revoking the special district had nothing to do with Disney’s comments about the parental rights bill.”

    Interesting no law suit has been filed by a company with all the means in the world to do so. Maybe it is the hubris of a few lawyers who prefer to teach K-3rd about sex ed but they just won’t take the case. :eek:o_O:confused::cool::D:devil::ninja3:;)

    ***DeSantis is a lawyer as well with many lawyers around him…I think he knows what he is doing which is standing up for Florida within the Constitution***

    Perhaps, but sometimes politicians act for purely political reasons. Obama taught constitutional law, and that didn’t seem to earn his actions any respect among his detractors.

    Apparently you don’t understand freedom of speech. Or bargained for property rights. The Iran analogy is spot on. The difference is just the degree of punishment for speech. Perhaps I should have used Russia, a government in which you right wing heroes model their behavior.

    You ardent going to teach the dictator worshipers here. They have also stood for the election lie because they only care about imposing their values on others. Freedom is their freedom to do that. They would welcome dictatorship over freedom if the dictator mirrored their values. The posts you are responding to reek of those values. The same bill that dictators peddle.

    Freedom of speech is only important to you all when it fits your narrative. Disney is free to continue with their pedo talk. They have lost 50 billion in value since announcing their stance. You should have used Russia. It's odd you did not. I know how hard it is to leave Russia out of any conversation. Do you think Russia would put this person in power?

    I used Russia in a different post. Whatever money Disney lost doesn’t matter to its right to speech. Unpopular speech is protected. Except In Florida. Where you have to agree with DeSantis or pay the consequences. Haven’t you noticed that his content based attacks keep being declared unconstitutional? And it’s your taxpayer dollars that are supporting the defenses of his attacks on free speech. As for your you tube link, it is off topic and I don’t care.
