    I object to “always “. My dad never did, but he always admitted it made him a crappy lawyer. :p

    I think self produced means it originated from his phone. It’s easy to determine if the photo on your phone originated from your phone. BUT, if what you say is true, that could explain the relative low bond (with seemingly silly conditions) and max time in jail of 20 months. ?

    Easy. Because this is a unique and highly sensitive situation. Most appear to understand that. If you want to participate in the speculations and extended discussions, @lacuna started a thread in Too Hot. Swamp Gas is a sports forum.

    That’s not how Florida’s scoresheet works. Unlike the feds, which give a scoresheet range of a minimum and maximum, Florida scoresheets set the minimum sentence. The only maximum is the statutory max, here 15 years for a 2F.

    That’s why you shouldn’t listen to people who know nothing of state criminal procedures.

    It seems that you’re asking whether possession requires that something be possessed. I think framing the question that way may give you your answer. However, I would add that when you view something online, your computer generally keeps those images in the cache which is stored locally on your computer. Whether that would be enough to meet the possession statute is probably a jury question.

    Here, however, it doesn’t look like that issue is present as Koran admitted to downloading the images.

    And forwarded them to someone else, which is how he got busted. The odds of him getting arrested were pretty slim but for the fact that he transmitted the images to at least one other third party.

    He's screwed.

    Actually, no we’re not talking about something very different… How many addicts do you know that ask for help until they are at rock bottom. Pretty sure this is rock bottom for him and his family!

    This is just not an assumption on my part, I happen to have some experience with people with this issue and it is very dark & ugly! But, with professionals that deal with this type of addiction he can be helped.

    Frankly, I think we are. In general, a pornography addiction can garner some sympathetic ears. I don't know who you go to with the issue that Kitna is dealing with without getting disgust and potential criminal referral in response. Do you? It might, in fact, be a legal liability not to report this.

    Addiction in general is very bad. Addiction to (legal) pornography is bad. But there are places to go for those things. I don't think there's a safe place to go for someone in Kitna's situation.

    As I stated before I have experience with people with this issue and unless you have “personally” dealt with it or with someone that has this addiction you may want to defer to someone that has.

    And yes, there are facilities and programs geared specifically for this addiction.

    And also as I stated in my original post it’s like any other addiction… An alcoholic needs more alcohol to get drunk, a drug addict needs harder drugs to get high, someone with a pornography addiction requires harder and hard-core pornography and if he’s at this point he started this a long time ago he didn’t just start this a few weeks or few months ago.

    I get it’s hard for someone especially a man to think someone could have an addiction to something so simple as looking at pictures. I could tell you stories that would raise the hair on the back of your neck, this is the worst type of addiction there is!

    it’s hard for someone without an addiction to understand it. Because most men have somewhere along the line looked at pornography and they think I never got addicted that’s Ridiculous… How many people drink and never have an alcohol problem, how many people have taken prescription drugs and never gotten addicted… Some people just have something in them that is prone to addiction… Unless you have an addiction issue you cannot understand it.

    I had no idea. Where are these? Seems like a very tough business to operate given your clientele is the kind of person law enforcement agencies are looking for.

    Again, I am aware that there are treatment centers for pornography addiction, but this is a very specific and illegal form.

    Certainly you understand that there is a much harder task to come forward with something that is near-universally detested, right?

    I think we want to differentiate between porn addiction vs pedophilia or other forms of sex offenses. Yes there are treatment programs for all kinds of addictions, whether it be drugs, alcohol, porn, gambling etc. Typically the "treatment" programs for sexual deviants occurs in the correctional/criminal justice system.

    20 months may sound like a slap on the wrist for some people. However, that may not be his only punishment.

    He may have to register as a sexual offender for the rest of his life.
    This means that anyone can google him, or check their local sexual offender web site. This means his address will be visible and he will be subject to harassment. Also, he will fail a lot at applying for a job because his criminal history will be a big flag.
