From what I understand, open carry is illegal in Florida unless you are going/returning from hunting, fishing, etc. There's only a couple situations where you can. But, that suspicion was quickly dispelled and the encounter should have been terminated right there. What's also troubling, imo, is the Suspicous Person (Loitering/Prowling) on the report.
The usual cop defenders in here defending and deflecting from more shitty police work. Like I said, these people will cry about the media, politicians, “Canadian people” etc all day long, but when it comes time to hold a few bad cops accountable they can’t do it. Lol

Also interesting from the second video is that the cops, in their report, claims this stop was based on suspicion of "loitering and prowling" ... even though the man was just walking down the sidewalk ... I wondered why the cops would make that claim ... and found this from an older article in the Orlando Sentinel. "Generally, if a person is being detained or arrested he would have to give up his name. However, each state has laws on the issue — called "stop and identify" statutes. In Florida, a police officer would have cause to arrest someone for refusing to identify himself when investigating a loitering or prowling incident, according to state law." That's why these laws are so slanted in favors of the cops. At no time during the stop did the officers tell him they were investigating him for "loitering and prowling", but later they write it in their report to give them a legal reason for the arrest.

There has been people exploiting the loophole in FL. Now that GA passed constitutional carry (legal concealed carry w/o permit,) I don't see too many open carriers here.

But I would like to thank you guys because every time you post one of these threads it reinforces what I have always known. If I am ever stopped and questioned by the police cooperate, show them my ID if they ask, answer politely don't bow up on them and there is a 99.99999% chance I am not leaving in handcuffs or under a blanket. it continues to amaze me that when off road in the back country, when game wardens interact with someone, almost always alone - it is highly probable - bordering on 100% chance - that the other person is armed and over the years in FL a few GWs have been shot and killed (and also the reverse) in the line of duty and yet I don't recall hearing or reading about a bad shoot or unnecessary use of force by a GW. They get training at the state LE Academy in Tally same as a lot of LE but then get some wildlife type special training. I've asked my GW buddies about it but none of them had an answer. I dunno, maybe a difference in the type of person attracted to the job.

Here's the definition of "loitering and prowling" from the FL Code. If "walking home on a public street" is included, I missed it. There is the problem. If you aren't doing anything wrong, there is no reason you should leave in handcuffs, despite the attitude given. The remote chance of ending up under a blanket speaks volumes. Depending on how I felt that day, If I know I hadn't broken any laws, I would either not identify and take the repercussions and file a lawsuit for 4th amendment violations.. Or.. Ask, on camera, what would happen if I didn't identify myself, and if the answer is "You're going to go to jail for failure to ID," I would make sure the bodycam, and my cellphone, picked up me saying "I do not want to identify as I have not broken any laws and failure to ID is a secondary violation, I will identify myself under duress." And then I would explore legal options. Sir, you are walking down the sidewalk in Athens, GA while wearing a Gators t-shirt. That is causing a public disturbance. I need to see some ID. -Wearing a Gators shirt on a public sidewalk is not illegal. I'm not showing you my ID. If you don't show my ID, I'm going to arrest you. -If I don't identify myself, you will take me to jail? Yes. -Get bent. (Profit)
And these wrongful arrest or wrongful death lawsuits do cost the citizens. In my dinky town the settlement in a recent lawsuit against the county caused my property tax to increase by $500 and it will stay that way for many years until the settlement is paid. (and I didn't even live here when the bad thing happened)
Off Topic: A couple weeks ago, my and the GF took my Jeep down the Georgia Traverse. Forestry roads, WMAs, Nat'l Forrest roads, etc from South Carolina, into NC, through North Ga, looping into TN, and ending up at the AL border. Good times. Saw bear sign (scat) 60 paces awar at one of our campsites. At another part of the trip, Tray Mtn in GA, got stopped by a couple mountain bikers and asked if we saw the bear. They said it crossed the road in front of them and stood up. About the time they said that, two cubs came down a tree that was about 15 yards from us. We were possibly between the assumed mom and the cubs. When we heard that, I asked them if they had anything for self defense. Spray or anything like that. He said he had forgot his bear bells that he usually has on his bike. I don't think I'd like to be unarmed, on a bike, in bear country.
what a waste of taxpayer money by arresting criminals over and over and over again only to have libbies let them go w/o bail or consequences.
Still OT. Wow. Awesome sounding trip. Bears in the back country away from the corrupting influence of man will almost always run from you when encountered (almost always). Mom woofs her cubs up a tree and then runs - if pressed and no tree available she will defend them to the death - yours or hers if you dont back off. Once or twice I bull rushed a family group to check on the status of a cub - in each case she just sent them up a tree and fled my ugly face. In all my years (27) of messing with bears I never carried spray or arms but some of my coworkers carried spray. I did get bit and slapped a couple of times - all deserved. A teeny female former tech of mine got a job in Montana and was severely mauled by a grizzly but managed to fight it off by spraying herself and the bear while it had her head in its mouth. She then crawled and hiked 3 miles to her truck and got herself to the hospital where she was treated for multiple skull fractures and deep lacerations to her neck and shoulders. Was a long recovery. She has done a few PSAs for carrying bear spray in the backcountry. She returned to work ASAP. Badass girl.
