Haven't read the whole Opinion, but the 5th Circuit seems to take the position that social media do not have their own right to "censor" speech based upon viewpoint. Even Angela Merkel was publicly against Twitter banning Trump. If we’re being honest, we all know the Twitter board was just waiting for an excuse to ban him. Dorsey said it was a “mistaken business decision” to ban Trump. Basically admitted it had nothing to do with trying to quell violence.

It is not trademarked. He has every legal right to use the phrase, as using it is actually protected by his rights. But I also have the right to point out that it is an attempt to appeal to people who don't understand what the First Amendment is and how it applies to social media platforms.

It sounds to me like his just stating a reality based on all those other city riots that the Dems started across the country.
