    Haven't read the whole Opinion, but the 5th Circuit seems to take the position that social media do not have their own right to "censor" speech based upon viewpoint. It's unclear to me to what extent the Court may have relied upon a finding that Twitter has some sort of monopolistic power or whether the Court was saying that Twitter's rules are analogous to government action.

    A Texas statute named House Bill 20 generally prohibits large social media platforms from censoring speech based on the viewpoint of its speaker. The platforms urge us to hold that the statute is facially unconstitutional and hence cannot be applied to anyone at any time and under any circumstances.

    Trump had his stop the steal rally on Jan 6th and prompted his followers to go to the capital - a violent attack ensued on our US capital by trump followers for trump.

    Can you give me one example... just one. I'm not saying that it's true, that he did or didn't say such a thing... But it seems like I have read Leftists not just glorifying, but espousing straight up violence on twitter.

    Let me help you out with this double standard, and censorship, that you Liberals have been 'enjoying' for a long time...

    Talk about glorifying.. Yep, there is "glorification of violence" on Twitter. Thank you for making my point.

    Twitter hosts a #KillTrump hashtag. In all of the glorious English language there is no clearer, plainer, or shorter way to call for violence than the word kill followed by someone’s name. But there it is. One of these tweets reads “#ArrestTrump not enough #KillTrump.” And this isn’t new, back in June the hashtag #AssassinateTrump was bouncing around the website with gems like “Someone take this clown out NOW.” That tweet is still up.

    Oh, so you mean he is referencing an important Constitutional Right and reducing it to a completely meaningless phrase meant to confuse people that believe their rights are violated by a social media banning? Agreed.

    Even Angela Merkel was publicly against Twitter banning Trump. If we’re being honest, we all know the Twitter board was just waiting for an excuse to ban him. Dorsey said it was a “mistaken business decision” to ban Trump. Basically admitted it had nothing to do with trying to quell violence.

    It is not trademarked. He has every legal right to use the phrase, as using it is actually protected by his rights. But I also have the right to point out that it is an attempt to appeal to people who don't understand what the First Amendment is and how it applies to social media platforms.

    So, by being honest in his opinion that, "when the looting starts the shooting starts." Somehow he's glorifying it?

    It sounds to me like his just stating a reality based on all those other city riots that the Dems started across the country. I don't see that and glorifying anything... except he is foretelling the truth of what's to come.

    Why don't you just admit the truth, Twitter censored Pubs and all things Pub while letting the commie Leftists have their say on their platform. But alas...

    It's a new day and a new owner that is heading Twitter now. And if you truly don't like the "glorification of violence" then you'll be okay with tons of Left-wing radicals getting the same treatment that the Dems on Twitter dished out to the Pubs.

    It's possible Trump didn't know, but that phrase has a dark and racial history from the civil rights era. Trump referenced it in a Tweet in which he said that "the Military" was with the Governor of Minnesota and that "any difficulty and we will assume control..." He didn't refer to store owners or even local cops. He seemed to be saying that he was going to use the U.S. military to assume control - which has its own issues aside from the history of that phrase.

    During the civil unrest in the United States that occurred during the long, hot summer of 1967, which were in part racially motivated, several nascent riots in Dade County, Florida, were stopped before they could start through the effort of local community leaders.[4]: 2–3  However, law enforcement personnel began to prepare for further violence, as the causes of the unrest were never addressed and promises made by leaders went unfulfilled.[4]: 3 

    The first known use of the phrase was in a press conference held by Miami's police chief, Walter Headley, on December 26, 1967. Headly announced that six three-man teams of officers equipped with "shotguns and dogs" would respond to the "young hoodlums" from "Negro districts" in Miami with lethal force[1][11] and stated "his men have been told that any force, up to and including death, is proper when apprehending a felon".[12] In a pithy soundbite during the post-statement interview with reporters, Headley claimed that Miami had avoided "civil uprising and looting" because he had "let the word filter down that when the looting starts, the shooting starts".[1][13][14]


    Headley stated: "Felons are going to learn that they can't be bonded out from the morgue."[15] Florida Governor Claude Kirk expressed his support for Headley's tactics: "Let them all know they will be dealt with [harshly]. We have the weapons to defeat crime. Not to use them is a crime in itself."[14] Headley added "we don't mind being accused of police brutality."[14] In a follow-up press conference, Headley refused to say whether the policy of shooting looters would only be applied to Blacks, given his previous stances, leading to a heightened state of fear among the Black communities of Miami.[4]: 3 

    A paraphrased version of his December 1967 remarks was quoted in his 1968 Miami Herald obituary: "There is only one way to handle looters and arsonists during a riot and that is to shoot them on sight. I've let the word filter down — when the looting starts, the shooting starts."[16][17] Anecdotes were shared that City of Miami police officers had started aggressively enforcing its stop-and-frisk law by stopping Black males in public with no pretext, calling them belittling or racist epithets, then demanding identification and their purpose.[4]: 3  Three weeks after the new policy started, Chief Headley declared that it had caused the violent crime rate to fall by 60%.[18] In contrast to the continuous harassment by Miami police officers, the Dade County Public Safety Department built relationships between its deputy sheriffs and the Black community; although both the City of Miami and Dade County were judged to have effectively maintained order, the Miami Police Department were perceived to have revived prior racist policies.[4]: 4

    I think it’s kind of like NYT Editorial endorsement. I’m not really bent out of shape. Not exactly a ringing endorsement either… he likes a divided government is terrible reasoning and won’t sway many (any?). If he came out with some biting indictment it might have impacted someone.

    actually when it comes to trump it’s maga who doesn’t like the truth - trump was suspended from twitter for fear of promoting more violence after his supporters attacked the US capital on jan 6th.
