State Supreme Court reinstates employees fired for refusing vaccine

    Ok? No one here has claimed it was the court of highest appeal have they? That's my point.

    The NY Supreme court issued a ruling. That is true.

    The vaccines work very well at reducing serious illness, hospitalization and death, but are less effective in reducing transmission. So, they do "work" and saved thousands of lives, but were disappointing in terms of reducing transmission.

    And I think the point of the case in this thread is that the mandates were build upon the premise of transmission.

    And the mandate was issued prior to the emergence of the Omicron and Delta variants both of which and especially the former are much more transmissible than the original and earlier variants of the virus. The science at the time the mandate was issued indicated that the vaccines were effective although not absolutely so at limiting transmission of the virus. Even assuming that the original rationale for the mandate is not completely valid anymore the City can still argue that it has an interest in ensuring that its employees are not infected with a serious case of the virus resulting the loss of significant work time.

    Which is the correct premise, despite people's inability to understand the science (including our judges apparently). However, it was proven AGAIN, that having a previous immune response to SARS-CoV-2 previously reduced transmission if infected again. Plain and simple science that has not changed since the beginning, despite some people simply unwilling to hear it and unable to understand it.

    I think we're all tired of Covid and ready to move on. But are courts in a better position to make these sorts of calls as opposed to elected leaders and health officials? What if the next pandemic is 10X worse than Covid? Not sure how courts are supposed to draw those sorts of lines, especially when it comes to regulations on government employees.

    But, when people declare broadly that the vaccines "don't work", they ignore the FACT that the vaccines work very well to reduce serious illness, hospitalizations and deaths. People need to be reminded of this FACT.
