    Bikini baristas win lawsuit over unconstitutional dress code

    A federal court says a city's dress code for scantily clad coffee servers is unconstitutional. The judge ruled that by targeting women's attire, the dress code violates the Equal Protection Clause of the U.S. Constitution. But the law does not violate the First Amendment, he ruled. Nor does criminalizing the baring of female breasts but not male breasts count as an unconstitutional violation.

    The case comes out of Everett, Washington, where drive-up shacks featuring "bikini baristas" are popular.

    In 2017, Everett passed a law prohibiting quick service food and drink peddlers from showing off certain body parts, including their stomachs, backs below the shoulder blades, and "top three inches of the legs below the buttocks." The city didn't even pretend to tie the law to food safety, instead citing concerns about potential exploitation of women and "adverse impacts upon minors."

    A group of bikini baristas working sued, calling it a matter of women's rights.

    I remember in Clearwater, probsbly late 80s or 90s, there used to be ladies that sold hotdogs on the side of the road in g-strings. I think the county or city made an ordnance against it. Not sure if it ever went to court, but they disappeared pretty quick after that.

    The best one ever was when the City of Casselberry which had several strip joints in the 80s wrote an ordinance outlawing nudity except in the theater. Which temporarily shut down the strip clubs until the owner of the Club Juana came up with the idea of Shakespeare in the nude. A few weeks later they rewrote the ordinance.

    I wonder if in a community where people view biological sex as the sole relevant consideration in other contexts, if they would attempt to apply prohibitions against breast or partial breast exposure to young trans women who have had top surgery?

    I think it might put them in a strange spot. Permit trans women to be bare-breasted around town wherever men can be shirtless....or draft a special ordinance treating trans women as cisgender women in this context since their boobs might also excite or offend.

    I remember them. My wife saw that I told me there’s no way she’s going to eat anything from a woman with an exposed arse. Said something about tugging on the string between her butt cheeks and then handling a hotdog.

    I went to a bar in Lakeland. I was underage, and went to the patio/dance area and there was a hot dog cart.

    Yep, early 90s in ocala, chicks in g strings selling hotdogs by the road. . Nothing distracting about that at all .

    Used to be a topless donut shop in Tampa circa 1985, just a few blocks from my girlfriend’s summer apartment. I threatened several times to pick up a dozen on the way from Gville for a weekend visit but never actually risked the consequences of girlfriend stink eye when weekends were short and to be fully enjoyed. I suspect I didn’t miss much at the donut shop.
