Does anyone else have the uneasy feeling that Judge Cannon’s words are not her own - that an unseen Federalist Society hand is deeply involved?
This to me is the hardest and strongest evidence that she is politically motivated. The extension of the timeline was deliberate.
I would defer to those with more knowledge of the rules of criminal procedure, although this is ostensibly a civil proceeding. But you can't seek to recuse a judge and request reassignment based upon a ruling you disagree with. And while the 11th Circuit has slapped her down already, as a matter of judicial politics, I could not see them voluntarily doing that, although they surprised me last time. At this point, I think the DOJ, and I'm only speculating, we'll just wait to appeal the matter until it's completed. I don't think they'll pursue anymore what are called interlocutory appeals of single orders. I say that because I think they have what they need to pursue the prosecution and a lot of this will get mooted. But again, I will defer to those with more knowledge, plenty of whom post here regularly
While she is an absolute embarrassment, in a way this might be good in the long run. Every excuse he could possibly raise is getting way more than fair treatment, so when he still gets convicted in the end, most of his excuses will be gone.none of these stall tactics by her will change the long term trajectory here.
If it goes back to the 11th is it the same panel that saw the previous appeal? If so they will likely take this as an insult and slap her down again. But if not, they could get a Trump panel this time. And then who knows.
No. The panel that reviewed the motion to stay was the motions panel. The motions panel had two Trump appointments. The plenary appeal will be heard by a different panel. I will be very surprised if the makeup of the panel matters. This court is aware of the violence that will be done to Rule 41 and related procedures if a party is allowed to file a civil suit instead of a motion for return of property in the warrant proceeding. This is a first in time issue as well. Judge Dearie raised it in his order.
The search warrant case was filed first and is open, pending, and can resolve the purported issues on a motion for return of property. Judge Cannon should have stayed out of it.

As Katzberg sees it, the Department of Justice could appeal, which they did late Friday, and that they may have a compelling case to ask for Cannon's removal -- although such moves rarely occur.
