Lindell Loses..Again

    A federal judge denied MyPillow CEO Mike Lindell's attempt to dismiss a defamation lawsuit brought by the Smartmatic voting technology company.

    The pillow magnate had asked the court to dismiss the complaint by arguing the company had failed to adequately make its case for defamation, and his attorneys argued that Lindell's election fraud claims were protected under the First Amendment, but U.S. District Judge Wilhelmina Wright denied the motions to dismiss, reported Politico.

    MyPillow also filed a motion arguing that Lindell's statements cannot be attributed to his company, but the judge denied that, as well.

    The court ruled that Smartmatic had made sufficient allegations to support its defamation case by demonstrating that Lindell had made knowingly false statements and acted with actual malice, and the judge ruled that MyPillow can be held liable for those claims because he allegedly defamed the tech company while promoting his company.

    'A false narrative': Judge slaps down Mike Lindell’s motion to dismiss Dominion defamation lawsuit (msn.com)

    The “actual malice” part is important. In the case New York Times v. Sullivan back in 1964, the U.S. Supreme Court under Chief Justice Earl Warren ruled that in a defamation lawsuit, the plaintiff has to prove “actual malice” on the part of the defendant — and making an honest mistake doesn’t qualify as actual malice. The High Court, in that unanimous ruling 58 years ago, made defamation very difficult to prove; former Alaska Gov. Sarah Palin, for example, lost her defamation lawsuit against the New York Times, as her attorneys were unable to demonstrate in court there was actual malice on the Times’ part.

    But Smartmatic, in its defamation lawsuit against Lindell and MyPillow, is arguing that Lindell didn’t make an honest mistake — he showed a total disregard for the truth and promoted a conspiracy theory that is divorced from reality.

    Wright, in her ruling, made it clear that she sees Biden as the legitimate winner of 2020’s presidential election.

    The judge wrote, “Lindell created and published a series of documentary videos that purported to provide evidence and facts substantiating his theory that the voting technology of Smartmatic and two other election technology companies, ES&S and Dominion, stole the 2020 election. Lindell advertised and provided election-related promotional codes for his products to viewers and listeners during internet, television and radio show segments in which Lindell allegedly defamed Smartmatic and promoted his documentaries. Lindell also sponsored a ‘March for Trump’ bus tour to twenty cities promoting the January 6, 2021 rally in Washington, D.C., during which Lindell rode in a bus bearing the MyPillow logo and endorsed the false narrative that former President Trump won the 2020 election.”

    Is smartmatic a public figure? Because if they are not, they don't have to prove actual malice to receive actual damages, just for punitive damages. .

    This is why some people think that their still could be hope for a continuation of the American Experience, that conservatives like yourself see through the scam being perpetrated on the American Public by Trump, Qanon, and their quasi facist supporters.

    We believe that real conservatives still support the right to vote, a representative democracy and a nation that, despite it's flaws, protects the values that have made it the ascendent power in the World post WW2.

    Students of history, of which I am one, have a pretty good idea what the end result will be should Trump and his ilk prevail.

    Take a hard look at N Korea, Russia, or Saudi Arabia for a glimpse into that future.

    I don’t really know much of what he said because I don’t watch CNN, Fox, or read the Washington Post. I know how they make their money. I’m a firm believer in his right to say whatever he wants no matter how much anyone likes or dislikes it whether he be left or right. I personally wouldn’t ruin my business by going on TV telling the world a bunch of nonsense.

    As are we all, BUT do you feel an obligation to confront liars whose lies endanger our Republic? It seems to me, and I may be wrong, that you're giving him a pass. We don't, for example, give our children a pass for lying and harming others.
