    Attempted murder, I believe, is actually harder to prove. It's a specific intent crime, whereas murder can be general intent. I'm also not sure how the felony murder rule applies to attempted murder, or if it is the law in all states. But you can easily be convicted of murder serving as the lookout in a robbery, even if you didn't know your accomplice was armed (even if it's a requirement for the offense, try getting anyone to believe you). If you burn down a house believing no one is home, and somebody is, you are probably getting convicted of murder. If you burn down an empty house and no one is injured, you probably aren't getting attempt.

    I also think, as a practical matter, a false conviction for murder is much easier than a false conviction for attempt. When there is a dead body, there often isn't anyone who can identify you.

    There are probably more circumstances where as a practical matter if not legal, you can get convicted of murder you did not actually intend to happen than an attempted murder.

    Here is the young lady killed in the car jacking. She had her daughter with her. Imagine seeing your mother murdered.[​IMG]

    You know exactly his point.

    He didn't post any such images of the people killed in Buffalo earlier this year (wild that it really was barely four months ago).

    For 515 some tragedies are just more tragic than others and, yeah, there's no doubt why :emoji_eyes:

    Oh yes he did... in defense of Trump using Buffalo to prove how great his record was in Afghanistan... NOT as an empathetic plea for the lives of the old Black church ladies gunned down in cold blood

    I guess I could answer White Lives Matter but the real answer is a child watched her mother brutally murdered because a legal system allowed a brutal attempted murderer to plead down to aggravated assault and serve just 11 months.

    So why was this noble impulse missing in the 21 page thread on the Buffalo shooting in which you posted multiple times? Either race based crimes are more acceptable to you or black victims aren't worth the same degree of empathy. Maybe both?

    Well maybe you can answer why there was so much posted about race & white supremacy in your Buffalo thread? I posted about a mother, not a thing about white, not a thing about black, simply a picture of a mother.. You are trying to turn this into your own little race baiting thread.

    There's a picture online of the first identified victim, Dewayne Tunstall, a 24 year old black father. I won't stoop to your level and use his photo as a prop.

    I just can't imagine you choosing his photo to humanize the story. Not in a million years.

    I explained above. A getaway driver who agrees beforehand to pick up a few of his friends who are committing an armed robbery would be technically a murderer if someone dies.

    Compare that situation to someone who stabs his girlfriend mutiple times because he suspects her of cheating (she lives).

    I think the latter is more agriegious.

    Please read post #3 & post #45. I posted a picture of a pretty young mother who was brutally murdered in front of her daughter. You are trying to read more into this than is there. As for the latest victim to be identified Mr Tunstall it is a crying shame too, for him and his children but I doubt I would have posted his picture if he had been identified first. My point posting the photo was to bring a little impact to the evilness of this crime, murdering a mother in front of her child.

    Try to spin it anyway you like, seems you are pretty good at making something out of nothing, you do it all the time.

    Let’s say the excess incarceration of non violent offenders is what We are looking at reducing. Murderers in jail? Yes; Simple marijuana possession type offenses? No.

    Upon reading about Tunstall you are right I would not have chosen him to humanize the story. Nothing against Tunstall but considering he and Kelly were friends I think the murder of a stranger carjacked in front of her little daughter humanizes a story a little better than a friend murdered at a BBQ.

    Well, your original post that I responded to was not this specific. Even so, this is a strange way to make a general statement that attempted murder is worse than murder. I'm no lawyer, but your scenario seems to be accessory to murder unless the DA is pissed and wants to drop murder 1 on the perp.

    We occasionally get posts about street crime and there are some posters past and present that when they do this, I already know the demographics of both the victim(s) and the perp. And I’m never wrong.
