At some point we need a real criterion for trustworthiness. Personally I prefer institutions to individuals, though both can be mistaken.

Agents ended up taking boxes and boxes of materials, claiming they contained classified material. Trump has confirmed he declassified the documents he had, which as president then he had the authority to do.

The whole declassification angle is garbage. Not one of the filings by Trump’s lawyers has referenced the declassification of documents as a defense as to why he had possession of the materials. Why? Because it’s just more of his bullshit. And even if he declassified them, they should have gone to the archivist, not Mar a Lago.

Why don’t you make a FOIA request and see if the guv will send you the declassified documents?

Relative to the warrant, an “overly broad” attack is always a risk. However, I did read somewhere (can’t remember where) that the reason some of the personal items like the passports were taken were to support the claim that the documents were improperly secured and commingled in with some everyday personal items. Time will tell if that proves correct.

The personal items such as Passports, and privileged items, such as medical records or items with attorney-client privilege were in the same boxes as the items the FBI were looking for. Since many of these boxes contained classified documents, including many Top Secret and TS/SCI documents, the agents conducting the raid didn't have proper clearance to open the boxes and check for content. That's generally not what FBI agents do with a warrant anyway.

What did happen was the boxes were taken, and as items were found to be not in the scope of the warrant, they were returned to Trump. The Passports have already been returned, and the DOJ has stated a small number of the docs are likely covered under attorney-client privilege last week.

The DOJ won't use the contents of the privileged docs for anything. But their existence will help prove that Trump had his lawyer lie on the affidavit when Trump stated he no longer had any classified docs in his possession.

In the end, this argument is silly. If the police are searching for drugs with a warrant, and find a box that contains heroin, but also recent medical records, if the police take this box, does it make the warrant void? Of course not. They are looking for the drugs, and found them. The med records are privileged, and can't be used against the alleged criminal other than to prove the defendant knew of the box's existence, since he/she put the medical records in it.
