It's the dem propaganda of the day. Even the FBI said months after 1/6 that there was only one-off scant evidence that there was a planned insurrection. If somebody takes this to higher court, it will be overturned. Some judge lacky in New Mexico can't declare an insurrection. On top of that, this guy didn't go inside the capitol building. Anybody ok with this is a fascist.
If judges can't declare something an insurrection, who can, specifically? He was given proper due process, and he lost. What system would you prefer? BTW, multiple people have now been charged with seditious conspiracy, so it seems like your anonymous report may not have been correct at the time or at least isn't correct currently.
