FBI Executed a Warrant at Mar a Lago; the Investigation Continues

    There isn’t a separation of powers issue. The question of Biden waiving the privilege is whether Trump nevertheless still has an executive privilege. It is the opposite of separation of powers— can the former president executive asset privilege against an executive agency. Because Biden ultimately commands the DOJ, whether he “stays out it” or not. You don’t handle a privilege from yourself.

    I've seen the question phrased as does this judge have a right to reinstitute a privilege Biden waived.

    Also, even if Trump were to win that argument, it only gives the Archives the rights to the documents not him.

    The question is whether Biden can waive the privilege if Trump still has a privilege. Also, how mane federal cases can there be to supervise this warrant? I expect that argument from the government and will be surprised if they don’t make it.

    I think the DOJ may take on the exec privilege issue in their 40 page response since Cannon seems to be taking a wonky stance on it.

    Wow! The FBI has 35,000 employees and this one guy was in charge of the Mar-a-Lago search, the Hunter Biden investigation and the voter fraud in 2020.
    At least his investigation of Al Capone was successful. But why didn't he find DB Cooper???

    Were any of you not aware that there has never been a Democratic FBI director? Every single one of them has been a republican.

    As for this new nutjob FBI agent story, the real story is that he just hit mandatory retirement age and wasn't escorted out of anywhere.

    The laptop issue is entertaining just from the fact that the laptop was sooooo tainted by all the hands that looked at it, prior to the gubmit, could criminal charges ever be sustained in court. Other than against Rudy ;)

    Sounds like Cannon is a MAGA judge with no concept or respect for the law. Hopefully Cannon gets slapped down hard by her superiors who make decisions based on the rule of law and not on their loyalty to DT.

    All the dems in that state need to change their registration and primary Graham out. It is why I keep my registration as pub is to be able to vote against MAGA madness in the closed primaries.

    Reaching retirement age and reaching mandatory retirement age are not necessarily the same thing. Reaching “retirement age” usually means just that you’re eligible to retire and collect benefits. I read somewhere that mandatory retirement for special agents is 57 years old, and I saw somewhere else that this guy is 52. However, I don’t know if either of those sources are correct. Do you have a good source on this?

    Just checked. Agents with 20 years of federal law enforcement experience can retire at 50. Agents with 25 years or more are eligible for retirement regardless of their age. He was almost certainly eligible to retire. Whether he may have been forced out is another question.
