For those whose brains have been turned to mush by right wing media: 1. Trump could not declassify documents just by thinking about it. He had to follow a set process which would lead to the removal of markings on said documents. 2. He still has no right to possess any of these documents as they belong to the National Archives not him. They are stolen property in his possession. 3. He is plainly guilty of section 793(e) of the Espionage Act for possessing National Defense Information (classification is irrelevant) and refusing to return it when asked multiple times. This section could not be better written as perfectly describing what Trump did.

It will be interesting to see what we can read in the government’s 40 page response. Presumably, there will be a “first filed” argument relating to why this judge should not hear this civil case at all. You just don’t have federal judges assume jurisdiction over matters in front of other federal judges and there is a federal judge already who reviews the magistrate’s rulings. The Trump team argues that Judge Cannon has “jurisdiction” because the magistrate cannot issue a civil injunction to preserve privilege. But Trump cited the Michael Cohen search warrant case, where an order concerning the appointment of a special master to raise privilege was issued in a search warrant case based on a motion. And there are strong cases addressing anti-injunction policies that interfere with prior filed federal cases. Especially civil injunctions in criminal cases and investigations. Judge Cannon entered her order before she even heard from the government in these or any issues. And we will see if the government alternatively addresses the merits of Tump’ filing.
There's a separation of powers issue too about instituting a privilege Biden already waived. Not to mention Trump is trying to assert executive privilege which would only mean it's the Archives materials not his to keep anyway.
Wheeler made a point on twitter that the DOJ requested the 40 pages because local rules only allow for 20. In that request, the DOJ takes note that trump's filing to Cannon last week was actually 21 pages, a trivial violation. I suspect they mentioned this to highlight that Cannon may be a bit bias toward her nominator. Between trump's request and Cannon's response, I'm glad an adult (the DOJ) is finally entering the party. Executive privilege, pfft..
